r <br />~~~~ U(-042f~ <br />CORRECTIVE REAL ESTATE MORTGAGE <br />RICHARD E. BOBBINS AND PATRICIA L. BOBBINS, husband and <br />wife, herein called the Martgagors, in consideration of <br />Thirty-Eight Thousand Five Hundred and Noj100 Dollars (~3s,500.00) <br />do hereby mortgage to MELLIE J. BOBBINS, herein called the <br />Mortgagee, the following described real estate in Ha11 <br />County, and State of Nebraska: <br />The South Sixteen Feet (16') of Lot Five <br />(5); all of Lot Seven (7} and the North <br />Twenty Feet (20') of Lot wine (9}, being <br />20' wide, north-to-south and approximately <br />175' Iong, east-to-west, all in Block <br />Thirteen (13}, in Scarff's Addition to <br />the City of Grand Island, Nebraska. <br />This Mortgage is atven to secure the payment of the sum <br />of $38,500.00 and interest thereon, according to the terms <br />of a certain Promissory Note of even date, executed by the <br />Mortgagors to the Mortgagee, due the 1st day of June, 1990. <br />The Mortgagors further agree to maintain insurance upon <br />the above described premises in an amount not less than the <br />indebtedness due the Mortgagee with a loss-payable clause in <br />favor of Mortgagors and Mortgagee as their interests may <br />appear. <br />The Mortgagors agree to pay all taxes and assessments <br />upon said premises and all other taxes, levies and assess- <br />ments levied upon this Mortgage and the Note which this <br />Mortgage is giver. to secure before the same become delinquent. <br />In the event the Mortgagors shall fail to obtain such insurance <br />ar pay such taxes before delinquent, the Mortgagee may <br />purchase such insurance and pay such taxes or other liens <br />and the amount so paid shall become due and payable forthwith <br />by the Mortgagors to the Mortgagee without notice or demand <br />and shall become part of the principal due under the above <br />mentioned Pramissary Note. <br />Zn the event the Mortgagors default in the payment of <br />said indebtedness or any irstailment thereof, or fail to <br />perform any of the other agreements herein, the Mortgagee at <br />Mortgagee's election may declare the entire debt secured by <br />this Mortgage to be due and caliectible at once; and may <br />foreclose this Mortgage for the satisfaction thereof. <br />This real estate Mortgage is heing filed to correct the <br />Real Estate Mortgage recozded as DacumEnt No. 80-002421 in <br />the records of the Hall County Register of Deeds in which <br />the real estate description incorrectly listed this groperty <br />as being the South 15' of Lot 5 and it should have been <br />listed as being the South 15' of Lat 5 and it should have <br />included the North 24' of Lot 9. <br />Signed this ~ day of <_ , 1981. <br />__-~'~ <br />~'- R hard E.
