LICENSE AGREEMENT THIS AGREEMENT by and between the amity of Grand Island. Nebraska, a municipal corporation in Hall County, hereinafter referred to as the City, and Western Heights Deveiopment,Co., a Nebraska corporation, hereinafter referred to as the Licensee. WZTNE~SETH: WHEREAS, the Licensee has received permits for the construction of two residential units for the Nor*_h Half (N~} of Lots Three (3) and Four (4), and the South Half (S~) of Lots Three {3) and Four (4), Block Thirty-three (33}, Lambert's Addition to the City of Grand Island, also known as John W. Lambert's Addition to the City of Grand Island; and WHEREAS, the structures must be connected to the sanitary sewer main located in the alley southerly of such lots; and WHEREAS, the location of said structures for future sales purposes requires the granting of a sewer service line easement for the North Half (N~j of Lots 3 and 4 across the South Half {S~) of Lots 3 and 4 for access to the sewer main located in the alley. NAW, THEREFORE, in consideration of the mutual covenants herein cgntained, the parties hereto agree as follows: 1, The City hereby grants to the Licensee permits to connect the two residential structures located on Lots 3 and 4, Block 33, Lambert's Addition, to the City sanitary sewer main located in the alley southerly of such Lots 3 and 4. 2. In the event the Licensee sells either of the above- described properties to a third party, the Licensee shall grant to a third party, or retain, a private sanitary sewer service easement across the South Half {S~} of Lots 3 and 4 for the purpose of main- taining said private sanitary sewer service line for the benefit. of tt~e structure located on the worth Half {?v 2} of Lots 3 and w, Block 33, Lamberts Addition. 3. The Licensee agrees that this document shall be filed in the office of the Hall County Register of Deeds for the purpose of n~tifyitsg future buyers. ~.~n~
