$Q--4 (3Ei ~7 ~ 3 <br />hereunder by the Buyer and upon its performance of all the terse <br />of this Contract of Sale, the Escrow Agent is authorized to de- <br />liver the Hiarranty Deed, Abstract of Title and other documents <br />to the Buyer. Ail payments under this Contract shall he gaid <br />directly to the Seller. It is agreed that the duties and abliga- <br />tions of the Eseraw Agent are as a depositary only and to hold <br />only the above-referred docusrsnts and to deliver then uliaa notice <br />o£ collation of the Contract by Buyer. The Escrow Agent shall <br />not be called upon to construe any contract or instrument and <br />event of any dispute between the parties, the Escrow Agent shall <br />have the right to hold the Abstract of Title and irarranty Dead <br />, until a mutual agreement has bean reached by the parties or until <br />the matter has been settled by a final judgment or decree of a <br />court of competent jurisdiction. <br />8. DEFAULT AND RE?4EDIfiS: If Buyer fails to make any pay- <br />menu due croon x ar per orm any o,f the terms of this Contract <br />as required of it far a period of thirty (3D) days after the samR <br />is due or to be performed, then Seller shall. have the option a,f <br />declaring a forfeiture and the entire amount then due and owing <br />shall become immediately due and pay;tble. In addition, Seller <br />shall ba entitled, upon default of Buyer, to foreclose the agree- <br />ment as provided by law and each of the parties are entitled to <br />arty other and further remedies either at law or in equity. <br />9. WAIVER: Any waiver of the Seller of the time and manner <br />of payeaent ue ereunder or time ar manner of performance of acts <br />required hereunder by the Buyer upon one occasion, shall not con- <br />stit,~e waiver ar relinauieh>aent of env right by Seller to demand <br />subsequent payments when due ar to demand perforreance by Buyer <br />in accordance with the terms of this Agreement or any or other sub- <br />sege.~nt occasion. <br />17. ,iSSit;?r't~N°- This iaatract of Sale may be assigned by <br />ilte Boyar proms="e i*_ , as ~sade all payments required 'Hereunder and <br />pe~f~,d all ^f the terms _ ..his [:;antrac:t, and upon securing <br />the written i?usent of Seller to such assigniffieni, which consent <br />shall not be unreasonably withheld and which must he given to a <br />financially responsible assignee.
