$~~ X05465 <br />Buyers further agree that if they shall fail to pay any taxes or <br />assessments levied or assessed against the real estate, or fail to gay <br />the premium of insurance, Sellars may pay said taxes, assessa~nts ar <br />premiums, and the amounts so paid shall become due and payable forthwith <br />by Buyers to Sellers without notice or demand and shall become apart of <br />the principal balance due under this contract. <br />If Buyers fail to pay any amount due under the terms of this contract, <br />or if Buyers fail to perform any of the other terns, covenants or `agreements <br />of this contract, or if Buyers shall abandon the real estate, the whole of <br />the indebtedness due under Lhis contract, together with any advances made by <br />Sellers as herein provided, shall become and be immediately due and payable <br />at the option of the Sellers without notice or demand, the same- being ex- <br />pressly waived, and Sellers may proceed to foreclose this contract in the <br />manner provided by law. <br />Failure of Sellers to exercise any optional remedy herby specified at <br />the time of any default shall not operate as a waiver of-the right of Sellers <br />to exercise such optional remedy for the same or°any subsequent default at <br />any time thereafter. <br />IX. <br />This contract is personal and binding upon the Buyers and Sellers and <br />is not transferrable without the express written consent of each party, <br />which consent shall not be unreasonably withheld. <br />X. <br />COVENANTS OF THE SELLERS. Upon payment of the purchase price in full, <br />with all interest theron, and the preformance by Buyers of all covenants and <br />conditions which by the terms of this contract, are r_o be performed by <br />Buyers, Sellars agree and covenant to convey the real estate to Buyers by <br />deed of g~Tterai warranty, subject, however, to all conditions, easements, <br />restriction and limitations of record to the rights of persons in possession; <br />to the lien of all unpaid taxes and assessments for public improvements; <br />and to any other encu~rance which, by the terms of this agreement, are to be <br />paid by Buyers. <br />%II. <br />GENERAL AGREEMENT OF PAATTES. Buyers and Sellers respectively bind <br />their heirs, successors an assigns to the faithful performance oz the terms <br />of this agreement. This agreement specifically supersedes any Offer of Pur- <br />chases made and entered into by and between the parties.
