<br />80--- d30 5 4 i 4 <br />JOINT TENANCY WARRANTY DEED <br />Jerry L. Benker and Jeanne M. Benker, husband and wife, GRANTOR, in <br />consideration of THi?TY-ONE THOUSAND FOUR HUNDRED ELEVEN AND 54/160 DOLLARS <br />($31,413.54) received from GRANTEES, Larry M. Merritt and Barbara J. Merritt, <br />husband and wife, conveys to GRANTEES, as joint tenants and not .as tenants <br />in comnron, the following described real estate (as defined in Neb. Rev. Slat. <br />76-201): <br />Lot Forty-one (41} in Ravenwood Subdivision, located in <br />the South Half of the Southeast Quarter {S~ZSE;) of Section <br />Thirteen {13) in Township Eleven (11) Narth, Range Nine (9} <br />West of the 6th P.M., Hari County, Nebraska, according to the <br />recorded plat thereof. <br />GRANTOR covenants (jointly and severally, if more than one} with GRANTEES <br />that GRANTOR: <br />(1) is lawfully seised of such real estate and that it is free <br />from encumbrances except for covenants, restrictions and easements of record; <br />(2) has legal power and lawful authority to convey fhe same; <br />(3) warrants and will defend title to the real estate against the <br />lawful claims of all persons. <br />As further consideration for the conveyance of this real estate, Grantees <br />for themselves and heirs, administrators, executors, successors and assigns, <br />do hereby covenant and agree that they will keep and maintain the brick pillar <br />which serves as the entry monument for Ravenwood Subdivision and which is <br />]oeated on said real estate. This maintenance shall include mowing the <br />weeds and grass adjacent to the pillar. In the event a fence is constructed <br />along and against Bismark Road, it shall be on the lot line of stockade <br />type no more or less than five foot in height.
