80--005326 <br />AGREEMENT TO SELL REAL ESTATE <br />~, <br />his agreement made and entered into this ~.,~ day <br />of , 1980, by and between John J. Rasmussen <br />and ady K. Rasmussen, husband and wife and joint tenants, herein- <br />after designated as grantors, and Richard f_ Cavanee, a married man <br />hereinafter designated as grantee, witnesseth: ' <br />That grantors agree to sell to the grantee and grantee agrees <br />to purchase from grantors, the fallowing described real estate <br />situated in the County of Hall and State of Nebraska, to wit: <br />Lot Eighty (80), in Buenavista Subdivision, an Addition to <br />the City of Grand Island, Nebraska <br />The grantee agrees to pay to the grantors as a full consideration <br />for the above described presmises the sum of Nine Thousand,~~Two <br />Hundred Dollars (59,200.00) payable as follows, to wit: <br />?moo rho us and Dollars ($2,000.00) the receipt of which is hereby <br />acknowledged as dawn payment, and One thousand Dollars ($1,000,00) <br />the fifteenth of each month thereafter until the total of Nine <br />Thousand Two Hundred Dollars f$9,200.flfl) is paid no later than <br />February I5, 1983. The final payment shall be for One Thousand <br />Two Hundred Dollars ($1,200.00). <br />All payments and settlements under this contract are to be made <br />by receipt of a check by grantors at 551 South Lincoln Street, Minden, <br />Nebraska, 68959. It is agreed and understood that time is pf the <br />essence of this contract. <br />Grantee shall have a period of time in which to examine the <br />abstract title to the above described property and shall have the <br />right to receive and examine such abstract of title before making <br />final payment prior to February 15, I981. Receipt is hereby acknow- <br />iedged by grantee of the abstract of title to the premises. Grantee <br />shall notify the grantors of any defects in the ab5traet of title <br />prior to October 1, 1980, and provide grantors a reasonable time <br />in which tc~ cure any defects in title prior to the final payment <br />being made February I5, I98I. Upon the approva3 of the title by <br />grantee on or before February I5, 1981, grantee shall make final <br />paysuent of fine Thousand Two Hundred Dollars ($I,20fl.00} above described, <br />grantor shall deliver a good and suffir.ient warranty deed to said <br />re 31 estate, free and clear of alI encumb~-anccs er.cept as ;o and <br />subject to any and all~«ni;:g v3rdinanees in bt:iiding and other <br />restrictions imposed by agreement, Iaw, ar ordinances Find ail <br />easements across said uremises for utilities.
