<br />PRAIRIE DATSUN, INC., a Nebraska corporation, of Grand Island,
<br />Nebraska, herein called the Grantor, in consideration of
<br />CA1E ~l1I~ ~#/. ~' receipt of which is hereby
<br />adknowledged, hereby grants and conveys unto the
<br />CITY OF GRAND ISLAND, NEBRASKA,
<br />a municipal corporation in Hall County, Nebraska, herein called the
<br />Grantee, a permanent and perpetual easement and right-of-way to
<br />survey, construct, inspect, maintain, repair, replace, extend, remove,
<br />and operate thereon underground electric utility lines, cables,
<br />terminals, transformers, surface markers, and other appurtenances
<br />connectFd therewith, in, upon, above, along, across, underneath, and
<br />through a tract of land located ir: part of Lot Twelve (12) of
<br />Commonwealth Business Park Third Subdivision, an addition to the
<br />City of Grand Island, Nebraska, mire particulary described as follows:
<br />A sixteen (16?-foot wide *_ract of land, t.ie center
<br />line being described as follows: Beginning at a point
<br />on the Sout3: line of Kaufman Avenue, thiity (30) feet
<br />East of the Northwest corner of said Lot Twelve (L2);
<br />thence southerly parallel to and thirty (30) feet East
<br />of the West line of said Lot Twelve (12) a distance of
<br />one hundred 1100) feet; thence westernly parallel to and
<br />one huadre3 (100) feet South of the South line of Kaufman
<br />Avenue a distance of thirty (30) feet to the Vest line
<br />of said Let Twelve (L2); said tract of Land containing
<br />0.048 acre, more or Less, as shown on the plat marked
<br />Exhibit "A", dated 7/30!80, attached hereto and incor-
<br />porated herein by reference.
<br />together with the following rights: unrestricted ingress and egress
<br />to the above described tract of land for the installation, maintenance,
<br />operation. and removal of such utilities and appurtenances.
<br />Such rights of incress and egress shall include all rights
<br />necessary for the full and complete use, occupation, and enjoyment
<br />of the easement herein granted, including the right to excavate and
<br />refill ditches and trenches, to remove, clear and keep clear of trees,
<br />bushes, hedges, undergrowth, and other obstructions interfering with
<br />the surveying, construction, inspection, maintenance, repair, replace-
<br />ment, extension, removal, or operation of such utilities. No improve-
<br />menu , structures, buildings, or fences of any kind whatsoever shall
<br />be allowed in, upon, above, along, across, underneath or through the
<br />easement herein granted.
