80= {104996 <br />23 <br />i2.5, (y) all non-operational costs and expenses incurred by <br />.the Partnership described in Section 8.3.1(B)(i) and (B)(ii) <br />and iz) any interest on Deficit Loans, over {B) the sum of <br />(i) all amounts payable in such ealendar year or fraction <br />thereof on account of the amortization (other than out of <br />the proceeds of any sale, refinancing or other capital <br />transaction) of any debts of the Partnership (including, <br />without limitation, loans secured by mortgages on the Prop- <br />erty but excluding (X) Deficit Loans and (Y) debts to the <br />extent repayable as provided in Section 12.5), and (ii) the <br />amount of the addition to the Cash Reserve Fund required to <br />be made for such year or fraction thereof pursuant to Section <br />11.3. <br />71.2 From and after the date of this Agree- <br />meat to and including December 31, 1981, the available net <br />income of the Partnership for each calendar year or fraction <br />thereof shall be retained by the Partnership to be used for <br />Partnership purposes subject to the terms of this Agreement, <br />and thereafter it shall be used and distributed as follows <br />and in the following order of priority: <br />11.2.1 An amount of available set <br />income shall first be used to pay first interest anti then <br />the principal balance of Deficit Loans. <br />11.2.2 An amount of available net <br />u <br />t.__ <br /> <br />
