s ' 80- ~,~~-~~~0 <br />6. Seller will furnish Buyer a good and sufficient <br />Abstract of Title showing clear and marketahle title of record, <br />in Seller. Seller will bring ,the said abstract up to date and <br />submit it to Buyer for examination by Buyer's attorney who shall, <br />within ten (10) days thereafter furnish a copy of his Title Opinion <br />to Seller. In the event there is an actual defect of title, <br />Seller shall have a reasonable time to clear such defect. <br />7. Buyer has already entered into possession of said <br />real estate. <br />8. Seller shall execute a warranty deed to Buyer and <br />deposit the same in escrow with the firm of McDermott ~ Hall, <br />Attorneys, for delivery to Buyer upon fulfillment of the terms <br />and conditions of this agrieement and payment of the principal and <br />interest in full. <br />9. Buyer may deduct the revenue stamps from the last <br />payment and place the same on the deed at the time the deed is <br />delivered to him for filing of record. <br />10. Seller will pay 1474 and prior years taxes, and <br />Buyer will pay 1475 and subsequent years taxes. <br />11. Buyer takes said property subject to it's own inspec- <br />tion, subject to the present zoning regulations, and pursuant to <br />it°s own inspection of the premises and not pursuant to any representa- <br />tions by Seller. <br />12. Buyer will pay all consideration due on the Union <br />Pacific Railroad Lease up to date. <br />13. Buyer will maintain fire, wind; and extended coverage <br />insurance upon the buildings on said real estate in an amount <br />required under the mortgage of record to the Overland National <br />Bank with lose payable to the Overland National Bank to the extent <br />of the equity of said bank, and to Seller for any equity dver•and <br />above the equity of the bank. <br />14. It is understood and agreed Chat failure of Buyer to <br />make the payments on the notes herein described when due, together <br />with the interest thereon, or failure to pay the real estate taxes <br />- 2 - <br />
