80- ~t1~933 2. The MASONS, their successors and assigns, shall have the right to make use of the sanitary sewer easement located along and upon Lot Two ('L) in said subdivision for the purposes of maintaining a sanitary sewer to serve Lot One (1) in said subdivision. MASONS shall have Che perpetual right to locate, construct, and maintain a sanitary sewer in such area together with the right of ingress and egress thereto, for the purposes of repairing or replacing such sanitary service. SMITHS shall be prohibited from planting trees, bushes, and shrubs or placing other obstructions upon, over, along, or underneath the surface of such easement area. In Che event that it is necssary for MA50NS, or their successors or assigns, to disrupt the surface of the premises in order to repair or replace such sanitary sewer, the MASONS, their successors and assigns, shall have the, duty to restore the surface of such Lot 'Ifao (2) properly filling and' tamping the premises to make such premises.. as level as it was before such repairs or replacements were made. In the event that the SMITHS, their successors or assigns, should violate this agreement and place any improvements on the surface car under the surface 'in the said easement area and it is necessary for them to be removed in order fnr the MASONS, their successors or assigns, to maintain or repair such water service line, the MASONS, their successors and assigns, shall have no duty whatsoever to restore such improvements. 3. It is further agreed that this easemenC agreement shall be binding upon the heirs, successors, and assigns of the parties hereto, that this easement agreement shall be filed of record and shall be binding upor.~the successors in interest to the parties to this agreemenC.
