<br />in hand paid, does hereby SELL and CONVEY unto

<br />of Hall County, State of Nebraska, the following described premises
<br />situated in Hall County, and State of Nebraska, to-wiC:' ',

<br />Quarter of the Northwest Quarter of the Southeast
<br />Quarter (W'~N~SE$NW~SE~i) of Section Twenty-One (21)
<br />in Township Eleven (11) North, Range Nine (9), West
<br />of the 6th P.M: , and. cont'a,ining'i two. and one-half 'I
<br />acres, more or less, according't'o the Government''
<br />survey thereof; and,
<br />', A certain tract of land located in the Southeast
<br />Quarter iSE$) of Section Twenty-One (21), Township
<br />Eleven (11) North, Range Nine (9), West of the 6th
<br />P.M., and more particularly described as follows:
<br />Commencing at the northwest corner of the North-
<br />. west Quarter of. the Southeast Quarter of the Nerth-
<br />west Quarter of the Southeast Quarter (NWxSEINWiiSEk}
<br />of said Section Twenty-One (21), running thence East
<br />along the Southerly line of said tract 330 feet,
<br />thence Narth at right angles 13~ feet, thence West
<br />at right angles 330 feet, and :thence South i.32 feet
<br />to the point of he ginning, and containing one acre
<br />- all subjecC, however, to the road along the West
<br />side of said premises,
<br />The intention being to convey hereby an absolute title in fee
<br />simple.
<br />TO HAVE AND TO HOLD the premises above described, with all
<br />appurCenances thereunto belong unto the said Elizabeth M. Harrison
<br />and to her heirs and assigns forever, provided always, and these
<br />presents are upon the express condition that if the said Berkeley
<br />Pump Company ar assigns shall pay or cause to be paid to the said
<br />Elizabeth M. Harrison or her heirs, personal representative or
<br />assigns, the sum of Fifty Thousand Dollars ($50,000.00), payable
<br />as follows; to wit:
<br />One Thousand Dollars ($1,000.00) on the 30th day of September,
<br />1980; and a like amount of One Thousand Dollars ($1,000.40) on the
<br />30th day of each month thereafter; such $1,000.00 monthly payments be-
<br />ing amortizing payments, first applied upon accrued interest at the
<br />rate of ten (10) percent per annum, and the balance in reduction of
<br />the principal; payments are according to the provisions of a Prom-
<br />issory Note of even date herewith; then these presents eo be void,
<br />otherwise to be and remain in full force.
<br />IT IS FURTHER AGREED: (1) That the mortgagor shall pay real
<br />estate taxes levied and assessed against the above described premises
<br />and before the same become delinquent; if it should fail to pay such
<br />taxes, the mortgagee may pay the same and sum so advanced, with in-
<br />terest at sixteen (16) percent per annum shall be forthwith repayable
<br />by the mortgagor, and this mortgage shall stand as security for the
<br />same, (2} Failure to pay any of the monthly amortizing payments
<br />when the same become due or failure to comply with any of the fore-
