WHEREAS, Bartz is in the process of rebuilding their hone and have poured a fireplace area on the north side of their residence inside the five foot:set,back llzne required forhbuilding~~ when they are constructed next to other structures, w~thini the City of Grand Island, and, WHEREAS, Jakubowski has no objections whatsoever to the construction of the home roceedin as started with the fire lacell P E P being located within such five foot set back area as the property now exists. WITNESSETH: 1. Jakubowski in consideration of $1.00, in hand paid, being the owner of The South Fifty Feet (50') and Eight Inches (8"} of the North One Hundred Three Feet (103') anti Four Inches (4") of the West One-Half (W'~) of Block Twa (2) in Pleasant Home Subdivision of Part of the East Half of the Southeast Quarter (E~SE~) of Section Twenty-One (21) in Township Eleven (11) North, Range Nine (9), West of the 6th P.M., City of Grand Island, Hall County, Nebraska, hereby waives any objection that they may have to the construction of the Bartz home on The South Fifty-six (56) Feet and Eight (8) Inches of the North One Hundred and Sixty (160) Feet of the West One-Half (W~) of Block Two (2) in Pleasant Home Subdivision of Part of the East Half of the Southeast Quarter (EASE»1 of Section 'T'wenty-one (?1) in Tocroship Eleven (11), North, Range Nine (9), tdest of the 6th P.f4., hall County, Nebraska, with the fireplace extending into the five foot set back required for sideyards under the zoning ordinance o£ the City of Grand Island, Nebraska, for structures located on the above described property owned by Bartz.
