Bartz, husband and wife, hereinafter called Bartz and Robert L. <br />Jakubowski and Isabelle B. Jakubowski, husband and wife,.lereinafter <br />called Jakubowski. <br />WHEREAS, Bartz is in the process of rebuilding their hone <br />and have poured a fireplace area on the north side of their <br />residence inside the five foot:set,back llzne required forhbuilding~~ <br />when they are constructed next to other structures, w~thini the <br />City of Grand Island, and, <br />WHEREAS, Jakubowski has no objections whatsoever to the <br />construction of the home roceedin as started with the fire lacell <br />P E P <br />being located within such five foot set back area as the property <br />now exists. <br />WITNESSETH: <br />1. Jakubowski in consideration of $1.00, in hand paid, <br />being the owner of The South Fifty Feet (50') and Eight Inches <br />(8"} of the North One Hundred Three Feet (103') anti Four Inches <br />(4") of the West One-Half (W'~) of Block Twa (2) in Pleasant <br />Home Subdivision of Part of the East Half of the Southeast <br />Quarter (E~SE~) of Section Twenty-One (21) in Township Eleven <br />(11) North, Range Nine (9), West of the 6th P.M., City of Grand <br />Island, Hall County, Nebraska, hereby waives any objection that <br />they may have to the construction of the Bartz home on The South <br />Fifty-six (56) Feet and Eight (8) Inches of the North One Hundred <br />and Sixty (160) Feet of the West One-Half (W~) of Block Two (2) <br />in Pleasant Home Subdivision of Part of the East Half of the <br />Southeast Quarter (EASE»1 of Section 'T'wenty-one (?1) in Tocroship <br />Eleven (11), North, Range Nine (9), tdest of the 6th P.f4., hall <br />County, Nebraska, with the fireplace extending into the five <br />foot set back required for sideyards under the zoning ordinance o£ <br />the City of Grand Island, Nebraska, for structures located on the <br />above described property owned by Bartz. <br />
