<br />EASEMENT
<br />Richard S. Smithson and-Judy L. Smithson, husband and
<br />wife, tenants in common, herein called-"Grantor",.whether one
<br />or mare, in consideration of One Dollar ($1.00) and other-good.-
<br />and valuable consideration, receipt of which is hereby acknowledged;.-
<br />and of the further agreement herein stated, hereby grants and
<br />conveys unto Town & Country Realty of Grand Island, Znc., herein.
<br />called the "Grantee", a permanent and perpetual easement and'-right
<br />of way to survey, construct, reconstruct, relocate, inspect, repair,
<br />replace, extend, remove, maintain and operate thereon, a fence and.
<br />other equipment and necessary appurtenances upon, along, across;
<br />underneath and through the tract of land and real estate described
<br />as follows:
<br />The Easterly 4.2 feet of Lot Seven (7}, in
<br />fractional Block Twelve (12), in Gilbert's
<br />Addition to the City of Grand Island, Ha11
<br />County, Nebraska.
<br />Grantee shall have the right of ingress and egress across
<br />Grantor's property for any purpose necessary in connection with
<br />the survey, construction, reconstruction, relocation, inspection,
<br />repair, replacement, extension, addition to, maintenance, operation,
<br />and removal of said fence. Such ingress and egress shall be exercised
<br />in a reasonable manner.
<br />Grantee hereby agrees to pay the Grantor or Lessee, as
<br />their interest may appear, for any damage to real or personal
<br />property, by reason of the survey, construction, reconstruction,
<br />relocation, inspection, repair, replacement, extension, addition to,
<br />maintenance, operation, and removal of said fence.
<br />It is further agreed that Grantor has lawful possession
<br />of said real estate, goad right and lawful authority to make such
<br />conveyance and that his or their heirs, executors, administrators,
<br />successors and assigns shall warrant and defend the same and will
<br />indemnify and hold harmless Grantee forever against the claims of
<br />all persons whomsoever in any way asserting any right, title or
<br />interest prior to or contrary to this conveyance.
<br />The Grantee is the owner of Lot Eight (S), in Fractional
<br />Block Twelve (12) in Gilbert's Addition to the City of Grand Island,
