<br />WHEREAS Billy W. & Callette R. Kilpatric , husband and wife
<br />(hereinafter usually referred to as "Homeowner", whether one or more) have
<br />entered rota a certain written HOUSING REHABILITATION GRANT AGREEMENT dated
<br />-the 15th day of ,,July 19 80 with the City of Grand Island,
<br />Nebraska, a municipal corporation (hereinafter usually referred to as "City"),
<br />acting through its Coumiunity Development Agency, for rehabilitation of a
<br />dwelling an premises awned by Homeowner which are hereinafter described, and
<br />for the granting by City to Homeowner of Federal funds in the amount of Seven
<br />Thousand--and no/100 ----------------------Dollars ($ 7 000.00 ) to be
<br />applied in payment of the cost of such rehabilitation, and
<br />WHEREAS, Homeowner in such AGREEMENT has, among other things, agreed (a)
<br />to repay 'such amount or, as the case may be, a part thereof to City in certain
<br />circumstances described in the AGREEMENT, and (b) to execute and deliver to
<br />6ity an instrument in recordable foxm granting to City a lien on the premises
<br />to secure such repayment,
<br />L NOW THEREFORE, i.n consideration of such AGREEMENT with City, Billy W. it
<br />Callett'e R. Kilpatric husband and wife (hereinabove and herein-
<br />- below referred to as "Homeowner"}:, do hereby grant to CITY OF GRAND ISLAND,
<br />NEBRASKA, a Municipal Corporation, its successors and assigns, a lien upon the
<br />foilotiring described real estate situated in Hall County, Nebraska:
<br />South 88 Feet of Lot Five, Block One
<br />Hundred Thirty Six,'U.P, Railway Company,
<br />an addition to the City of Grand Island,
<br />Nebraska, according to the recorded plat
<br />thereof,
<br />to secure repayment to the City of Grand Island, Nebraska, its successors and
<br />assigns, of the amount of the grant hereinabove referred to or, as the case
<br />may be, a part thereof in accordance with the terms and conditions set forth
<br />in the HOUSING REHABILITATION GRANT AGREEMENT to which reference is made herein-
<br />above. _
<br />The lien herein granted shall run with the premises and shall also bind
<br />the successors and assigns and, except as~provided in such AGREEMENT, the
<br />personal representatives, heirs, devisees and legatees of Homeowner.
