<br />WHEREAS Dominic & Victoria Marshalek husband and wife
<br />{hereinafter usually referred to as "Homeowner", whether one or more) have
<br />entered into a certain written HOUSING REHABILITATION GRANT AGREEMENT dated
<br />the hth day of July Z9 g0 with the City of Grand island,
<br />Nebraska, a municipal corporation (hereinafter usually referred to as "City"),
<br />acting; through its Community Development Agency, for rehabilitation of a
<br />dwnlling'on premises owned by Homeowner which are hereinafter described, Ind
<br />for the granting by City to homeowner of Federal funds in the amount of Six
<br />Thotrsanrl Nine Hundred Sixty Seven & No/100 Dollars ($ b,967.00 ) to be
<br />.applied in payment of the cost of such rehabilitation, and
<br />WHEREAS, Homeowner in such AGREEMENT has, among other things, agreed (a)
<br />to repay such amount or, as the case may be, a part thereof to City in certain
<br />circumstances described in the AGREEMENT, and (b} Co execute and deliver to
<br />.City. an ?nstrument in recordable form granting to City a lien on the premises
<br />to secure. such repayment,
<br />NOW, THEREFORE, in consideration of such AGREEMENT with City, Dominic
<br />and Victoria Marshalek , husband and wife (hereinabove and herein-
<br />-. below referred to as "Homeowner"); do hereby grant to CITY OF GRAND ISLAND,
<br />NEBRASKA, a Municipal Corporation, its successors and assigns, a lien upon the
<br />fol?owing described real estate situated in Ha 11 County, Nebraska:
<br />Westerly Seventy Six Feet of Easterly One Hundred Eighty Two
<br />Feet of Souther y Two Hundred Twenty Six Feet of Lot Eight,
<br />Norwood Subdivision
<br />an addition to the City of Grand Island,
<br />Nebraska, according to t-he recorded plat
<br />thereof,
<br />to secure repayment to the City of Grand Island, Nebraska, its successors and
<br />assigns, of the amount of the grant hereinabove referred to or, as the case
<br />may be, a part thereof in accordance with the terms and conditions set forth
<br />in the HOUSING REHABILITATION GRANT AGREEMENT to which reference is made herein-
<br />above.
<br />The lien herein granted shall run with the premises and shall also hind
<br />the successors and assigns and, except as'provided in such AGREEMENT, the
<br />personal represen*_atives, heirs, devisees and legatees of Homeowner.
