<br />WHEREAS _ Lloyd M. & Sharon R. Marshalek husband and wife
<br />(hereinafter usually referred to as "Homeowner", whether one or more} have
<br />entered into a certain written HOUSING REHABILITATION GRANT AGREEMENT dated
<br />the 8t1: day of .Iuly 19 80 with the City of Grand Island,
<br />Nebraska, a municipal corporation {hereinafter usually referred to as "City"),
<br />acting thiough its Community Development Agency, for rehabilitation of a
<br />dwelling on premises-owned by Homeowner which are hereinafter described, and
<br />-for the granting by City to Homeowner of Federal funds in the amount of Six
<br />thousand Six Hundred and-Eight Five no(101gollars ($6,685.00 ) to he
<br />applied in payment of the cost of such rehabilitation, and
<br />WHEREAS, Homeowner in such AGREEMENT has, among other things, agreed (a)
<br />to repay such amount or, as the case may he, a part thereof to City in certain
<br />circumstances described in the AGRF,EMENT, and (b) to execute and deliver to
<br />City an instrument in recordable form granting to City a lien on the premises
<br />to secure such repayment,
<br />NOW, THEREFORE, in consideration of such AGRF.EDtENT with City,. Lloyd M. £e
<br />Sharon R. Marshalek husband and wife (hereinabove and herein-
<br />below referred to as "Homeowner"), do hereby grant to CI1Y OF GRAND ISLAND,
<br />NEBRASKA, a Municipal Corporation, its successors and assigns, a lien upon the
<br />fallowing described real estate situated in Hall County, Nebraska:
<br />Westerly Seventy One Feet of Easterly One hundred Six Feet of Southerly
<br />Two Hundred Twenty ix eet o t ig t, erwoo u vision
<br />an addition to the City of Grand Island,
<br />Nebraska, according to the recorded plat
<br />thereof,
<br />to secure repayment to the City of Grand Island, Nebraska, its successors and
<br />assigns, of the amount of the grant hereinabove referred to or, as the case
<br />may be, a part thereof in accordance with the terms and conditions set forth
<br />in the HOUSING REHABILITATION GRANT AGREEMENT to which reference is made herein-
<br />above.
<br />The lien herein granted shall run with the premises and shall also bind
<br />the successors and assigns and, except as'provided in such AGREEMENT, the
<br />personal representatives, heirs, devisees and legatees of Homeowner.
