<br />2. Water. The Subdivider agrees to petition the City for <br />the construction of all necessary water mains in the subdivision to <br />serve all lots in the subdivision as approved by the City's Director <br />of Public Works, and subject to the City's inspection. <br />3. Sanitary Sewer. The Subdivider agrees to petition the <br />City for the construction of all necessary sanitary sewer mains in <br />the subdivision prior to requesting any occupancy permits for any <br />structures in the subdivision, and agree to connect such structures <br />to the Gity's sanitary sewer: <br />4. Drainage. The Subdivider agrees to grade the lots of the <br />Subdivision in conjunction with the structures thereon so that the <br />storm water drains in accordance with plans, the design and construction <br />thereof, having been approved by the City's Director of Public Works. <br />5. Sidewalks. The Subdivider, if still the owner of the land <br />in the proposed subdivision, or if the Subdivider shall have trans- <br />ferred title to the property, then the various grantees thereof, will <br />install, at their own expense, aLl public sidewalks required by the <br />Grand Island City Code when the adjacent lot is built upon, and side- <br />walks shall be regulated and required with the building permit for <br />each such lot. <br />6. Warranty. The undersigned owner, as Subdivider, warrants <br />that it is the owner in fee simple of the land described and proposed <br />to be known as BRENTWOOD THIRD SUBDIVISION, and that an abstract of <br />title will be submitted for examination, if necessary, upon request <br />of the City of Grand Island. <br />7. Pedestrian Way. The Subdivider agrees to construct a <br />pedestrian right-of-way, at Subdivider's expense, between Lots 33 and <br />34 of said subdivision, said right-of-way shall have a four foot paved <br />s?.detvalk within said six foot right-of-way, and a 42 inch high chain <br />link or solid wood fence on each side of said right-nf-way. Subdivider <br />shall complete said right-of-way when street paving is installed. <br />8. This agreement shall run with the land and shall be binding <br />upon and inure to the benefit of the parties hereto, their successors, <br />assigns, heixs, devisees, and legatees.
