<br />the real estate described on Exhibit "A", which is attached

<br />4. The Thompson Co., inc., is the owner of all or

<br />Paragraphs ~ and 7.~ hereof. ~--

<br />Reab, Ellinor K. Reab, and the Union Pacific Railroad, and
<br />each of them severally, entered into a construction contract
<br />with Chief Industries, Inc., Chief Construction Division, a
<br />copy of. which contract is marked Exhibit "B", attached
<br />hereto and made a part hereof by this reference.

<br />February 28, 1980, Chief Constxuctic~n, a division of %hief
<br />Industries, Inc., furnished all of the labor anei materials
<br />and did all of the construction work required by the contract
<br />which is Exhibit "B" hereto.
<br />7. As shown by the contract, which is Exhibit "D"
<br />h~sreto, the gross contract price was 540,71'.00. Of that
<br />amount The Thompson Co., Inc. has paid the sure of Si.1,452.00
<br />leava,ng an unpaid balance in the amount of 529,255.00 plus
<br />interest thereon at the rate of I;z~ per month, which interest
