$t}-~. <br />REAL ESTATE MORTGAGE <br />DAVID E. PHILIPPI, herein called the Mortgagor,: isi <br />consideration of $3,955.40, does hereby mortgage to P1'FAI1~Ik: <br />DAT5UN, INC., herein called the Mortgagee, all of-his r3:g3sTt, <br />title, claim and interest in and to the folhowing aeser3,: <br />real estate in Hall County, and State of Nebraska: <br />See attached Exhibit 1. <br />And the Mortgagor does hereby covenant with tkse Mortgagee <br />and with Mortgagee's heirs and assigns that Mortgagor. is <br />lawfully seized of said premises, that they are subject to <br />encumbrance of record, that Mortgagor has good right and <br />lawful authority to convey the same, and that Mortgagor <br />warrants and will defend the title to said premises against <br />the lawful claims of all persons whomsoever. <br />This Mortgage is given to secure the payment of the <br />principal sum of $3,955.40, and interest thereon, according <br />to the terms of a certain Promissory Note of even date, <br />executed by the Mortgagor to the Mortgagee, due the ~ day <br />of March, 1933. <br />The Mortgagor further agrees to maintain insurance upon <br />the above described premises in an amount not less than the <br />indebtedness due the Mortgagee with a loss-payable clause in <br />favor of Mortgagor and Mortgagee as their interests may <br />appear. <br />In the event of default in the performance of any of <br />the terms and conditions of this Mortgage or the Note <br />secured by it, the Mortgagee shall be entitled to immediate <br />possession of the property above described and all the <br />rents, revenue and income derived therefrom during such time <br />as the Mortgage indebtedness remains unpaid shall be applied <br />by the Mortgagee to the payment oz` the Note and all other <br />sums secured hereby after deduction of any necessary costs <br />of collection. <br />In the event the Mortgayor defaults in the payment of <br />said indebtedness or any installment thereof, or fail to <br />perform any of the other agreements herein, the Mortgagee at <br />Mortgagee's election may declare the entire debt secured by <br />this Mortgage to be due and collectible at once; and may <br />foreclose this Mortgage for the satisfacti//on thereof. <br />Signed this ~ day of ~~~ ~ t ' Lt" 1980. <br />f .~ f' <br />David E: Pfil <br />STATE OF NEBRASKA <br />(as: <br />COUNTY OF HALL ) <br />Before me, a Notary Public qualified for in saki County, <br />personally came David E.
