<br />acknowledged, hereby grant and convey unto the
<br />CITY OF GRAND ISLAND, NEBRASKA,
<br />a municipal corporation, in Hall County, Nebraska, herein called
<br />the Grantee, a permanent and perpetual easement and right-of-way
<br />to construct, operate, maintain, extend, repair, replace, and remove
<br />a sanitary sewer, manholes, surface markers, and other appurtenances
<br />accessary far sanitary sewer operation and maintenance, upon, in,
<br />and through a tract of land located in Fanner Second Subdivision
<br />in the City of Gran-i Leland, Nebraska, more particularly described.
<br />as follows:
<br />Beginning at the Southeast corner of Lot Five (5},
<br />Fnnner Second Subdivision; thence West nn the-South
<br />line of said Lot 5 a distance of 258 feet (78.638 meters};
<br />thence North nn a line 258 feet (78.638 meters) West of
<br />and parallel to the East Line of said Lat S a distance
<br />of eight (8) feet (2.438 meters); thence East an a
<br />line sight (8) feet (2.438 meters) North. of and
<br />parallel to the South line of said Lnt 5 a distance
<br />of 258 feet (78.638 meters) to the East line of said
<br />Lot 5, thence South an the East line of said Lot 5
<br />a distance of eight ($) feet (2.438 meters} to the
<br />Southeast corner of said Lot 5, said point being the
<br />point of beginning, as shown nn the plat marked
<br />Exhibit "A" attached hereto and incorporated herein
<br />by reference,
<br />together with the following rights, namely, unrestricted ingress and
<br />eg~cess under and across such land for the purpose of exercising the
<br />rights herein granted, to clear and keep clear of trees, roots,
<br />brush, and other obstructions from the surface of such tract. Any
<br />such utilities and appurtenances placed upon and under such tract
<br />of land shall remain the property of the Grantee and may be removed
<br />ar replaced at any time.
<br />Tits Grantors, far themselves, their heirs, executors, adminis-
<br />trators, successors and assigns, hereby covenant that. no buildings,
<br />fences, or structures shall be erected or permitted on said tract
