VACATION AND WITHDRAWAL OF EASEMENT The undersigned, JOSEPH E. SETLIK and DOROTHY M. SETa,IK, husband and wife, and CLARENCE L. SHUDA and VERNIE K. SHUDA, husband and wife, being the then owners and the present owners of the following described real property: Lots Four (4), Five (S), Six (6), Seven (7), Eight (8), Nine (9), and Ten (10) in west- roads Estates Fourth Subdivision in Hall County, Nebraska, did by instrument dated July 3l, 1979, and recorded on August 16, 1979, as document No. 79-OOS330 in the office of the Resister of Deeds of said county create an easement for utility purposes over a gortion of the above-described lots in favor of the pub- lic and for gurposes therein stated. The grant of said easement has been ineffective to establish 'said easement for the reason that the public has not accepted the same, and no action has been taken to comply with the provisions of Article 9'. of Chapter 16 of the Revised Statutes of the State 'o;f Nebraska, said statutes being the governing ones regarding ', '',uzban development. The undersigned therefore declare that said instrument above described shall be held for naught, and the parties hereby vacate and withdraw said instrument.
