BE IT ORDAINED BY THE h1AY0R AND CO[RQCIL OF TSIE CITY OF GRAND ISLAND, NEBRASKA: SECTION 1. Sanitary Sewer'District No. 451 of the City of Grand Island, Nebraska is hereby created for [he laying of an eight-inch, or 20.32 centimeters, vitrified clay pipe, or polyvinalchloride plastic pipe, and appurtenances thereto. SECTION 2. The boundaries of such sanitary sewer district shall be as follows: Beginning at a point on the East Line of Lincoln Avenue, said point being 50 feet North of the South line of Gamma Street; thence running South on the Ease line of Lincoln Avenue and ehe Sauth prolongation of the East line of Lincoln Avenue for a distance of 62 feet; thence running t2esc on a line parallel co and 12 feet South of the South Line of Gatvma Street for a distance of 30 feet; thence running South on a line parallel to and 268 feet Eas[ of the Eas[ line of Svlvaa Strcec for a distance of 132 feet to the North line of Stoney Park Road; thence rune i.nE, hest on the North line of Stoney Park Soad for a distance of 12S feet; thence running Nor t!: on a line paral?.ei co and i40 feet Easy of the East line of Sylvan Street for a distance cf 195 feet to the i:orth li;;e c.~ Gaf^~+.a Street; thence running East of the \orth line of Gamma Strcet~for a distance of 158 foet to the East line of Lincaln Avenue, bein,r, the point of beginning, all as shoc.^.~ en the plat marked Exhibit "A" attached hereto and incorporated herein by reference. SECTION 3. Said improvemenes shall be made in accordance with plans and speci- fications prepared by the Engineer for the City who shall estimate the cost thereof, grid submit the same to the City Cavncil, and upon approval of the same, bids for the construction of such sanitary sewer shall be taken and contracts entered into in the manner provided by law. SECTION 4. The cost of construction of such improyemen[s shall be assessed against the property within the district abutting upon the street or other right-of- way within which such sanitary sever main will be constructed within such sewerage district to the extent of benefits to such gropercy by reason of such improvement, and a special tax shall be levied at one time to pay for such cost o£ construction as Soon as can be ascertained, as provided by law; and, provided further, such special tax and assessments shall constitute a sinking fund for Che payment of any bonds with interest issued far the purpose of paying the cost of such. sewer in such district; such special assessments shall be paid and collected in a fund to be designated and lmown as the Sewer and Water Extension Fund, and out of which all warrants issued for the purpose of paying the cost of such sanitary sewer shall be paid. ..YM"EO ~ 70 E'ORtr1 EF3 ° ~ 1980 LEGAL DEPARTP3~ _~ i
