<br />REAL ESTATE MORTGAGE <br />THZS MORTGAGE, made and entered into this ~~ day of <br />1980, by and between MILLER MANUFP.CTURING <br />COMPANY, a Nebraska corporation (hereinafter referred to as the <br />"Company"} and THE OMAHA NATIONAL BANK, a national banking associa- <br />tion of Omaha, Nebraska, (hereinafter referred to as "Sank") which <br />Bank is the Bank unde~~r,/a~n agreement entitled "Loan Agreement" dated <br />the l8~day of ~•./%lac.~-mac 1986; <br />WITNESSETH: <br />WHEREAS, Company and Bank entered into an agreement en- <br />titled "Loan Agreement" dated on the ~stday of ~Is...r.R , <br />1980; <br />WHEREAS, Company has an interest in the real estate des- <br />. cribed on Exhibit "A" attached hereto and made a part hereof by <br />- reference located in Grand Island, Hall County, Nebraska, by <br />virtue of the provisions of an agreement entitled "Lease and Agree- <br />. <br />ment" by and between The County of Ha11, Nebraska and Company dated <br />as of September 1, I9?b; <br />WHEREAS, Company and Bank desire to secure by these presents <br />the faithful performance of and payment of the Notes (as defined in <br />said Loan Agreement, in the original principal amousst of $2,000,000) <br />and interest and of any other debt, demand, liability or obligation <br />of Company to Bank under said Loan Agreement or under any other agree- <br />- meat between Company and Bank and as security for any other debt, <br />demand, liability or obligation of Company to Bank arising by operation <br />of law or otherwise; <br />NOW, THEREFORE, far and in consideration of the Loan A~aree- <br />ment and far other good and valuable consideration, receipt of which <br />is hereby acknowledged, in order to secure the faithful performance <br />- of and payment of the Notes (as defined in said Loan Agreement, in <br />the original principal amount of $2,000,000} and interest and of any <br />tither debt, demand, liability or obligation of Compa.iy to Sank under <br />
