<br /> <br />CORRECTIVE WARRANTY DEED <br />F. E. ELLINGTON and BET'PY. L. ELLINGTON, husband and wife, <br />each in his and her own right and as sgouse of each other, herein <br />Dolled the Grantors, for and in consideration of the sum of TEN <br />DOLLARS (510.00) AND OTHER VALDABLE CONSIDERATION received from <br />Grantees, do grant, bargain, sell, convey and confirm unto 3AMES <br />}i. ROOP and DONNA R. ROOP, husband and wife, as joint tenants <br />with right of survivorship and not as tenants in common,- herein <br />called the Grantees, the following-described real estate situated <br />in Hall County, Nebraska: <br />A certain parcel of real estate located in the South- <br />west Quarter of the Southwest Quarter (SW~SW~} of <br />Section Twenty-one (21), in Township Eleven (11) North, <br />Range Nine (9) West of the sixth P,ri., more particularly <br />described as follows: Commencing at a point 163.3 feet <br />West of the Southeast Corner of the Southwest Quarter <br />of the Southwest Quarter (SW~SW'~) of said Section <br />Twenty-one (21), running thence North and in a line <br />Parallel with the East Boundary line of said Southwest <br />Quarter of the Southwes± Quarter (SW~SW~) a distance of <br />244,7 feet; thence at right angles and in a Westerly <br />direction 320 feet; thence at right angles and in a <br />Southerly direction, 240.? feet; thence at right angles <br />and in an Easterly direction, 120 feet, to the place of <br />oeginning, subject, however, to the highway right-of-way <br />over the Southerly 33 feet thereof. <br />TO HAVE AND TO HOLD tie above-described premises together <br />with all tenements, hereditaments and appurtenances thereto <br />belonging unto the Grantees and to their assigns, or to the heirs <br />and assigns of the survivor of them forever. <br />And Grantors do hereby covenant wit's the Grantees that <br />Grantors are lawful3y seized of said premises; that they are free <br />froaa encumbrance; that they are conveyed subject to covenants, <br />conditions, restrictions, reservations and easements of record; <br />that Grantors have good right and lawful authority to convey the <br />same; and that Grantors warrant and wilt defend the title to said <br />promises against the lawful claims of all persons whomsoever. <br />It is the intention of ail parties hereto that in the event <br />of the death of either of the Grantees, the entire fee simple <br />title to the real estate shall vest in the surviving Grantee. <br />Dated sz:ru~rv a 1980. <br />~iJ- D©Gt~l~t£t~ITJ1RY <br /> ~-~ ~-, ~: ~ -:- ge-~e L,r-re-~ <br />~ _~ <br />~y~ J Ffl <br />R.~3it''` F.
