<br />WARRANTY DEED
<br />1. The City of Grand Island, Nebraska, by action of its City
<br />Council on July 11, 1977, enacted Ordinance No. 6161 which directed the
<br />conveyance of the real estate described below and the manner and terms
<br />thereof.
<br />2. Ordinance No. 6161 was published in the Grand Island Daily
<br />Independent according to law, and notice of such sale and the terms
<br />thereof was published in the Grand Island Daily Independent for three
<br />consecutive weeks, on July 18, July 25, and August 1, 1977, all as
<br />required by Section 16-202, R. R. S. 1943.
<br />3. No remonstrance against such sale was filed with the City
<br />Council of the City of Grand Island, Nebraska, within thirty days of the
<br />passage and publication of Ordinance No. 6161.
<br />4. Section 5 of Ordinance No. 61bi provides that if no remonstrance
<br />be filed against such conveyance, the Mayor and City Clerk-Finance Director
<br />shall make, execute, and deliver to Lofgreen and DeFreece Buildersza~`"'
<br />warranty deed for said real estate, and the execution of such deed is
<br />hQrQ~y authorized without further action en behalf of the City Council.
<br />NOkT, THEREFORE, the Cit,F of Grand Island, Nebraska, a municipal
<br />corporation in Hall County, Nebraska, as Grantor, in consideration of
<br />$4,375.flfl received from Grantee, does hereby grant, bargain, sell, convey,
<br />and confirm unto
<br />LOFGREEN AND DeFREECE BUILDERS, INC.
<br />herein called the Grantee, the folloking described real property in Hall.
<br />County, Nebraska: '
<br />Fractional Lots Five (5) and Six (S), all of Lot Seven (7),
<br />and Lot Eight {$), plus the westerly forty (40) feet of
<br />vacated Superior Street, as vacated b; Ordinance No, 5995,
<br />enacted August 24, 1976, all in Fractional Black Fifteen
<br />{15), Lambert's Addition; and Fractional Lots Six (6), Seven
<br />(7), and Eight {$), in Fractional Black Eight {5), Evans
<br />Addition, ail in the City of Grand Island, Ha11 County,
<br />Nebraska.
<br />To have and to hold the above described premises, together with all
<br />te~~°*sts, ?,ereditents and appurtenances thereto belonging unto the
<br />Grantee and to Grantee's heirs, devisees, executors, administrators,
<br />successors, and assigns, forever.
<br />And the Grantor does hereby covenant with the Grantee and with
<br />Grantee's heirs, devisees, executors, administrators, successors, and
<br />assigns that Grantor is lawfully seized of said premises; that they are
<br />free from encumbrance, except easements of record; that Grantor has good
<br />rigl±t and lawful authority to convey the same; and that Grantor warrants
<br />and will defend the title to said premises against the lawul claims of
<br />all versons v3~asaever.
