<br />RUDOLF F. PLATE and JEANNICE R. PLATE, husband and wife, each in
<br />his and her own right and as spouse of the other, of Grand Island,
<br />Nebraska, herein called the Grantors, in consideration of One Lollar
<br />($1.00), receipt of which is hereby acknowledged, hereby grant and
<br />convey unto the
<br />CITY OF GRAND ISLAND, NEBR4SKA,
<br />a municipal corporation, in Hall County, Nebraska, herein called
<br />the Grantee, a permanent and perpetual easement and right-of-way
<br />to construct, operate, maintain, extend, repair, replace, and
<br />remove public utilities, including but not limited to, sanitary
<br />sewers, storm sewers, water mains, underground and overhead electric
<br />lines, telephone lines, manholes, pipe lines, surface markers, and
<br />other appurtenances, upon, over, in, underneath, and through a
<br />tract of land described as the West eight (8) feet, or 2.438 meters,
<br />of Lot 3, and the East 8 feet, or 2.438 meters, of Lot 4, Former
<br />. View Second Subdivision, as shown on the plat marked Exhibit "A"
<br />attached hereto and incorporated herein by reference, together with
<br />the following rights, namely, unrestricted ingress and egress under
<br />and across such land for the purpose of exercising the rights herein
<br />granted, to clear and keep clear of trees, roots, brush, and other
<br />f
<br />obstructtions from the surface of such tract, Any such utilities
<br />and apgurt~nances-p_lac~d_upon,_puer, and under sngh tra~G of land

<br />shall remain the property of the Grantee and may be removed or
<br />replaced at any time.

<br />The Grantors, far themselves, their heirs, executors, adminis-
<br />stratgrs, successors and assigns, hereby covenant that no buildings,
<br />fences, or structures shall be erected ar permitted on said tract
<br />and that the easement herein granted shall run with the title to
<br />Ruch tract of land and be binding upon the Grantors, their heirs,
<br />executors, administrators, successors and assigns.
