ORDINANCE N0. 6544 An ordinance creating Sanitary Sewer District No. 450 in the City of Grand Isiand, Nebraska; defining the boundaries of the district; providing for the laying of a sanitary sewer main in said district; providing for plans and specifications and securing bids; providing for the assessment of special taxes for constructing such sewer and collection thereof; and providing for the effective date thereof. BE IT ORDAINED BY THE PIAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA: SECTION 1. Sanitary Sewer District No. 450 of the City of Grand Zsland, Nebraska, is hereby created for the laying of an eight-inch, or 20.32 centimeters, vitrified clay pipe, or polyvinalchloride plastic pipe, and appurtenances thereto. SECTION 2. The boundaries of such sanitary sewer district shall be as follows: Beginning at a point on the East line of St. Patrick Avenue, said point being 437.75 feet North of the North line of O'Grady Street; thence running South on the East line of St. Patrick Avenue for a distance of 437.75 feet co the North line of O'Grady Street; thence running West on [he West prolongation of the North line of O'Grady ~ Street for a distance of 60 feet to [he West Line on St. Patrick ~l Avenue; *_hence running North on the West line of St. Patrick Avenue ~41 ~ rn i." for a distance of 12.95 feet to the Southeast corner of Lot 5, Dickey o ~ m ~ Seventh Subdivision; thence running West on the South line of said ~ a: Lot 5 for a distance of 1$3.18 feet to the west line of Dickey Seventh `~ a Subdivision; thence running North on the West line of said subdivision ~ w for a distance o£ 354 feet to the Northwest corner of Lot 9, Dickey ~ ~ Seventh Subdivision; thence running East on the North line o€ said Lot 9 o a for a distance of 1$2.73 feet to the West Lin.: of St. Patrick Avenue; 4 ~ thence runningg North on the West line of St. Patrick Avenue for a ~ distance o£ 70.$ feet to the Northeast carnet of Lot 10, Dickey Seventh Subdivision; thence running East on the East prolongation of Che North line of said Lot LO for a distance of 60 feet, to the point of beginning, all as shown on the plat marked Exhibit "A'" attached hereto and incorporated herein by reference. SECTION 3. Said improvements shall be made in accordance with plans and speeifi- cations prepared by the Engineer for the City who shall estimate the cost thereof, and submit the same to the City Council, and upon appraval of the same, bids for t[ie ems- struction of such sanitary sewer shall be taken and contracts entered irittr in the n~.:er - - -- provided by Iaw, SECTION 4. The cost of construction of such improvements shall be assessed against the property within the district abutting upon the street ar ether right-af-way within which such sanitary sewer main will be constructed within such sewerage district to the extant o£ bens#its to such property by reason of such improvement, and a special tax shall be levied at one Cime to pay for such cost of construction as anon as can be ascertained, as provided by law; and, provided further, such special tax and assessments shall constitute a sinking £und far the payment of any bands with tnterest Issued for the purpose of paying the coat of such sewer in such district; such special assessments shall bs paid and collected in a fund to be designated and known as the Sewer and Water Extensioq Fund, and out of which all warrants issued fox the purpose of paying the coat of such sanitary sewer shall be paid.
