<br />LYNOS J. RERUCHA and SHARON RERUCHA, as husband and wife,
<br />and in their own right, herein called the Grantor, whether

<br />Thirty Eicxht Cents ($ 143,687.38 ) , received from Grantee,
<br />does grant, bargain, sell, convey, and confirm unto ROBERT K.
<br />POLAND and WILLIAM D. SAPP, as tenants in common, herein
<br />called the Grantee, whether one or more, the following
<br />described property in Hall County, Nebraska:
<br />A part of the Southwest Quarter of the Northeast Quarter (SW 1/4 NE 1/4)
<br />of Section Twenty-one (21), in Township Eleven {11), North, Range Nine
<br />(9), West of the 6th P.M., more particularly described as follows:
<br />Commencing at a point on the center line of Phoenix Avenue Seven Hundred
<br />Seven and Nine Tenths (707.9) Feet Westerly from the intersection of
<br />Lincoln Avenue and Phoenix Avenue (as shown by plat of South Park,
<br />= now vacated), which point is at the intersection of the center line of
<br />Phoenix Avenue and the West line of the East Half of the Southwest
<br />Quarter of the Northeast Quarter (E 1/2 SW 1/4 NE 1/4}of said Section
<br />Twenty-one (21); thence South along said West line, which lire is the
<br />center line of the county road now called and used as South Adams
<br />Street, a distance of Four Hundred {400) Feet; thence East at right
<br />angles to last course a distance of One Rundred Seventy-nine (179)
<br />Feet; thence North parallel with said West line of the East Half of
<br />the Southwest Quarter of the Northeast Quarter (E 1/2 SW 1/4 NE 1/4)
<br />of said Section Twenty-one (21), a distance of Two Hundred Fifty-four
<br />and Eight Tenths (254.8) Feet to a point; thence Norther-ly in a curved
<br />line, concave Eastwardly of a radius of Four Hundred Sixty-eight and
<br />Twenty-eight Hundredths (468.28} Feet, tangent to the last described
<br />course, a distance as measured in the arc of said curve of One Hundred

<br />TO HAVE AND TO HOLD the above-described premises together
<br />with all tenements, hereditaments and appurtenances thereto
<br />belonging unto the Grantee and to Grantee's heirs and assigns
<br />forever.
<br />Grantor does hereby covenant with the Grantee and with
<br />Grantee's heirs and assigns that Grantor is lawfully seised
<br />of said premises; that they are facee from encumbrance except
<br />the following;
<br />General taxes and assessmznts for the year 1979 and
<br />thereafter; building tines, covenants, conditions,
<br />easements, and restrictions of record, party wall
<br />rights or agreements, if any, roads and highways and
<br />coning and building ordinances; and a mortgage given
<br />by Grantor to the Commercial National Bank and Trust
