<br />That F. S. Gassman, Trustee, in the exercise of the
<br />power of sale conferred upon him, does hereby execute and deliver
<br />< this indenture,
<br />tdITNESSETH THAT:
<br />F7HEREAS, for a valuable consideration on the 12th $ay of
<br />September, 1975, Raymond J. Berar. and Jean R. Beran, husband and
<br />wife, as Trustor, executed and delivered their Trust Deed to F. S.
<br />Gassman, Attorney-at-Law, as Trustee, and American Savings Company,
<br />a Nebraska Corporation, as Beneficiary, conveying the real estate
<br />hereinafter described in trust, with power of sale, in accordance
<br />with the terms and provisions set forth therein; that said Trust
<br />Deed was thereafter recorded on the 19th day of September, 1975, in
<br />the Office of the Register of Deeds of Hall County, Nebraska, as
<br />noted in Book 170 of Mortgages at Page 647, et seq., and
<br />Tr~jjEREAS, the Trustor having defaulted in the payment of
<br />the indebtedness secured thereby and the Beneficiary having delivered
<br />to the Trustee a written declaration of default and having deposited
<br />with the Trustee all promissory notes; together with Piotiee of
<br />Default; and
<br />bVHEREAS, in compliance with Sec. 76-1006, Statutes of
<br />Nebraska, on the 13th day of August, 1979, the Trustee filed a
<br />Notice of Default in the Office of the Register of Deeds of Hall
<br />County, Nebraska, as noted as Document 2do. 74-005244, Grantor C,
<br />Grantee W, Numerical 18, in the Miscellaneous Records, which Notice
<br />fully complied with the requirements of said statute, and
<br />PIHEREAS, in compliance with Sec. 76-1008, Statutes of
<br />Nebraska, on the 18th day of August, 1979, the Trustee mai3ed, by
<br />Certified Mail, with postage prepaid, a copy of such Notice of
<br />Default with the recording date shown thereon, addressed to Raymond
<br />"' J. Beran-and Jean R. Beran, 2307 Arrowhead Road, Grand Island,
<br />Nebraska., 68801, being the address of the Trustor as set forth in
<br />the Trust Deed, which mailing of notice fully complizd with the
