<br />LEASE
<br />WHEREAS, Marrison-Quirk Grain Corporation entered into a certain
<br />written lease agreement effective March 15, 1972, for a five-year
<br />term to end on March 14, 1977, with Arthur P, Terry and Maxine M.
<br />Terry, husband and wife, therein and herein referred to as Lessors
<br />of certain property located in Hall County, Nebraska;
<br />WHEREAS, Quirk Land & Cattle Co., a Nebraska corporation, is
<br />presently in possession of such property as successors in interest
<br />to Morrison-Quirk Grain Corporation and as such is responsible for
<br />performance of the terms of the lease previously entered into, and
<br />therefore, hereby acknowledges that all improvements including, but
<br />not limited to the fences, windmills, water systems, electrical
<br />systems, plumbing and sewer systems, heating systems, house, machine
<br />shed, horse barn, hay storage barn and roadways located thereon are,and
<br />shall continue to be kept and maintained in a good state of repair
<br />and the mechanical portion thereof in good working order.
<br />W'riEREAn, both.Qu3rk Land & Cattle Co. and the Lessors recognize
<br />that certain work should be done on the premises and the Lessors naa
<br />agree to replace the septic tank, place a new roof on the house,
<br />caulk and re-putty the windows and paint the house, place new com-
<br />bination screens and staarr windows on the h^use, repair the roof Qn
<br />the barn and repair the doors on the horse barn at the expense of
<br />the Lessors, aTl of which is to be accomplished previous to March 15,
<br />1977. Quirk Land & Cattle Co. agrees to contribute up to $ S-ocf
<br />to accomplish such improvements and pay such sum as may be allocated
<br />to them by the Lessors on or before March 15, 1977;
<br />NOW THEREFORE, this agreement is made and entered into this ~ ~
<br />day of ~~~ ~y~~~r , 1976 effective, however, on the 15th day of
<br />March, 1977, by and between Arthur P. Terry and Maxine M, Terry, hus-
<br />band and wife of Grand Island, Nebraska hereinafter referred ~ as
<br />Lessors and Quirk Land & Cattle Co „ a Nebraska corporation, Hastings,
<br />Nebraska, hereinafter referred to as Lessee,
<br />W I T N E S S E T H:
<br />That the Lessors have this day leased unto the Lessee effective
<br />the 15th day of March, 1977, real estate located in Hall County,
<br />Nebraska, more fully described on a separate sheet attached hereto,
<br />marked Exhibit A, and made a part of this lease as though fully set
<br />forth herein and as outlined on a separate plat map attached hereto
<br />marked ExY:ibit B, and made a part of this lease as though fully set
<br />forth herein, together with all buildings, fences, wells and other
<br />improvements situated on such property and belon~inq to the Lessors
<br />EXCEPTING an area of approximately 30 to 40 acres in the Northeast
<br />Quarter of Section 35-10-10, which consists of 2 lakes and access
<br />thereto and such area as shown in purple on Exhibit,B, attached
<br />hereto, which enure area is fenced and the fencing shall be main-
<br />tained by the Lessors.
