<br />ASSIGN.-iEPdT <br />FOR VALUE RECEIVED, the undersigned, JAMES L. DURY and <br />SHERRILL A. DORY, husband and wife, do hereby assign, transfer and <br />set aver to the Commercial Savings Company of Grand Island, Nebraska, <br />all our right, title and interest in and to a certain "Real Estate <br />Installment Sale Contract" dated April 1, 1979, in which James L. <br />Dory and Sherrill A. Dory were sellers and Orville J. Pedersen and <br />Mary J. Pedersen were buyers, notice of which contract was recorded <br />in the Office of the Register of Deeds of ~r-f~.t. County, <br />Nebraska, an the JvZ- day of ~~C~t.L`/ 1979, and which <br />covers the following described real estate, to-wit: <br />Part cf the East Half of the Southwest Quarter of the <br />Northeast Quarter (EzSW4NE%4} of Section (10) in Township <br />Eleven (11) North, Range Nine (9}, West of the 5th P.M., <br />Hall County, Nebraska, more particularly described as <br />follows: Commencing at a point Two Hundred Sixty-four <br />(264) feet North of the Southeast Corner of the Southwest <br />Quarter (SW 4) of the Northeast Quarter (NE 4) of said Section, <br />running thence West for a distance of Three Hundred Thirty <br />(330) feet, thence running North for a distance of One <br />Thousand and Fifty-Six (1056) feet, thence running east for <br />a distance of Three Hundred and Thirty (330) feet to the <br />Northeast Corner o€ the Southwest Quarter of the Northeast <br />Quarter (SW4NE4) of said Section and thence running South <br />a distance of One Thousand and Fifty-Six (1056) feet to the <br />place of beginning, excepting therefrom a tract of land more <br />particularly described in the Report of Appraisers recorded <br />in the Ha11 County Register of Deeds Office in Book 29, Page <br />377. <br />This assignment and transfer is, however, subject to the condition <br />that if a certain promissory rote for the sum of $53,236.80 dated <br />July 12, 1979, given to the Commercial Savings Company of Grand <br />Island '^y assignors, is well and truly paid according to the terms <br />thereof, then this assignment shall be void.
