<br />Grantors, WALTER BARTELT-and u.ABEL S. vARTELT, husband and
<br />wife, of Daniphan, Hahl County, Nebraska, for and in considera-
<br />tion of One Dollar (51.00) and other good and sufficient consid-
<br />eration paid, do hereby grant unto VER1d F. FRICKEY and JO ANN E.
<br />FRICICEY, husband and wife, as joint tenants, their successors and
<br />assigns, the right-of-way and easement to construct, install,
<br />maintain, replace and aperate an underground pipe line for the
<br />transportation of gas in, under and through the southerly six (6)
<br />feet of a tract of land comprising a part of Lot Ore (1), Bartelt
<br />Second Subdivision in the Village of Doniphan, HaII County,
<br />NAbraska, described as commencing at the southe«st corner of said
<br />Lot One (1), thence running north along the east line of said Lot
<br />One (1), (which is also the westerly boundary of Church Street as
<br />platted) a distance of One Hundred Thirteen and Fifteen Hundredths
<br />(113.15) feet, thence at right angles west and parallel with the
<br />south line of said Lot One {1) a distance of Seventy-seven and
<br />Seventy-four Hundredths (77.74) feet, thence at right angles south
<br />and garallel with the east line of said Lot One (1) a distance
<br />of One Hundred Thirteen and Fifteen Hundredths (113,15) feet to the
<br />south line of Lot One (1), and thence east upon said south line
<br />to the point of beginning.
<br />This right-of-way grant and easement shall continue so long
<br />as such pipe line shall be maintained, together with the right of
<br />ingress and egress from said premises for the purpose of construct-
<br />ing, inspecting, repairing, maintaining, renewing and replacing
<br />the gas line, or removal thereof. Grantors retain the right to
<br />use and enjoy the premises, subject only to the right of Grantees
<br />to use the same for the purposes herein expressed.
<br />Grantees agree to lay all pipe at a depth as not to interfere
<br />with the normal use of the ground by Grantors, to pay Grantors for
<br />any damage to the surface including any improvements, and to re-
<br />place alJ. dirt excavated in substantially the same manner as
<br />removed with top soil to be the same as that removed in excavating.
<br />The provision of this grant and easemen~ shall be binding
<br />upon the parties hereto, and the personal representatives, suc-
<br />cessors and assigns of the parties and survivors.
