WHITT, husband and wife, herein <br />called the Grantors, in consideration of <br />ONE .~3ecc/}B ~'{/ ~„~ receipt of which is hereby acknowl- <br />edged, hereby grant and conve3' unto the <br />CITY OF GRAND ISLAND, NEBRASKA, <br />a municipal corporation in Hall County, t7ebraska, as Granr_ee, a <br />permanent and perpetual easement to construct, operate, maintain, <br />repair, replace, and remove underground electrical transmission <br />and distribution lines, in, upon, underneath, and through two tracts <br />of land located in part of Lot One (1), Shady Lane Subdivision, <br />Hall County, Nebraska, mare particularly described as follows: <br />Tract Na. 1 <br />The westerly sixteen (16) feet of the easterly two <br />hundred twenty-four and four-tenths (224.4) feet, except <br />that part covered by an existing dedicated easement; <br />Tract No. 2 <br />The easterly sixteen (16) feet of that part of Lot <br />One (1) lying between Lot Six (6) and Lot Seven (7}, and <br />South of the existing dedicated easement; said tracts of <br />land containing 0.099 acres, more or less, as shown on <br />the plat dated 1OJ24l79 marked Exhibit "A", attached <br />hereto and incorporated herein by reference; <br />together with the following rights, namely, unrestricted ingress <br />and egress within, thraug't~, and across the above described tracts <br />of land for the purpose of exercising the rights herein granted, <br />and the right to clear and keep clear of trees, roots, brush, <br />shrubbery, and other obstructions from the surface of such ease- <br />ment areas. <br />All underground electric lines placed within the easement area <br />shall remain the property of the Grantee and may be removed or <br />replaced at any time. <br />The Grantors, for themselves, their successors and assigns, <br />hereby covenant that no structures or other obstructions shall be <br />erected oz percaitted an the easement areas described above. <br />- 1 - <br />
