<br />EASEMENT
<br />This easement agreement entered into this
<br />day of November, 1978, by and between A. C. Schroeder an Margaret
<br />E. Schroeder, husband and wife, hereinafter referred to as
<br />"SGHROEDER", ene or more, MAYHEW FRODUCTS, INC., a Nebraska cor-
<br />poration and Jerry Mayhew, single, hereinafter referred to as
<br />"MAY'rIEW" .
<br />t~lHEREAS, SCHROEDER is the owner of Tract #1, MAYHEW PRO-
<br />DUCTS, INC. is the owner of Tract #2 and MAYHEW is the owner of
<br />Tract #3, a13 as shown on the plat dated June 26, 1979, marked
<br />as Exhibit A attached hereto and incorporated herein by refer-
<br />ence, and
<br />WHEREAS the foregoing owners desire to grant-cross ease-
<br />ments to each cther for the purpose of :seating a road right-of-
<br />way sixty feet in width, being thirty feet on either side of the
<br />lot line common to Lot 5 and Lat 6 in Voss Subdivision in the

<br />the Southerly right-of-way line of U. S. Highway No. 30 and the
<br />North line of Lot 2 in sa;.d Vass Subdivision.
<br />NOW THEREFORE, in consideration of the mutual covenants
<br />contained herein, the parties agree as follows:
<br />1. SCHROEDER, as owner of Tract #1, MAYHEW PRODUCTS, ING.,
<br />as owner of Tract #2, and MAYHEW, as owner of Tract #3, all being
<br />wore particularly described on Exhibit A attached hereto, do here-
<br />by grant, bargain, sell, convey and confirm unto the said SCHROEDER,
<br />?lAYHEk' PRODUGTS, INC. and MAYHEW, a permanent and perpetual ease-
<br />ment and right-of-way for ingress, egress, road and driveway pur-
<br />poses and for the location, construction and maintenance o£ pub-
<br />lic and private utilities across Tract #l, Tract #2 and Tract #3
<br />as shown on Exhibit A attached hereto for the purpose of providing
<br />for each other a right-of-way for road and utility location for
<br />the benefit of the undersigned parties' respective aLutting real
<br />estate.
<br />2. The parties hereto agree that this easement and agree-
<br />Bent shall also operate as a dedication and caveyance to County
<br />of Hall or the City of Grand Island, Nebraska, for road and util-
<br />ity right-of-way purposes if accepted by either of said govern-
<br />mental subdivis=ans.
<br />3. This easement agreement shall run with the land and
<br />shall be binding upon the parties hereto, their respective personal
<br />representatives, heirs, devisees, successors and assigns.
