<br />CONDITIONAL ASSICNA',ENT OF LEASES AND RENTS <br />This Assignment is executed by HEINSmAN ENGINEERING, <br />INC., a Corporation, (Assignor) to ITT DIVERSIFIED CREDIT CORP., <br />CO.MMPsRCIAh FINANCE DIVISION, a Corporation, (Assignee). <br />The Assignor, in consideration of the sum of One <br />million tight Hundred Thousand and no/100 Dollars ($2,800,000.00), <br />received by the Assignor, hereby assigns to the Assignee, <br />its successors and assigns, all of the rents and profits from <br />the real estate (property) described as follows: <br />Tract I: Apart of the NWT of the SW's of <br />Section 27, Tawnshig 11 North, Range 9 West <br />of the 6th P.m.: in Hall County, Nebraska, <br />more particularly described as follows: <br />Beginning at a point on the West line of said <br />Section 27, Tawnshio 11 North. Rance 9 West <br />said point being located 32.0 feet North <br />of the NW corner of the SW} of the SW~t of <br />said Section 27; running thence East parallel <br />with the South line of said SW~t of the SW~ <br />a distance of 660.0 feet; running thence North <br />parallel with the West line of said Section <br />27 a distance of 336.0 feet; running thence <br />West parallel with the South line of said <br />SW~t of the SW~ a distance of 6bfl.0 feet, to <br />a point on the West Sine of said Section 27; <br />running thence South along and upon the West <br />Sine of said Section 27 a distance of 336.0 <br />feet to the point of beginning, subject to <br />County Road (Now South Locus} Street). <br />Tract II: A12 that part of the SEC of Section <br />27, Township 11 North, Range 20 West of the <br />6th P.M., in Hali County, Nebraska, lying <br />South of the Uaion Pacific Railroad Company, <br />as shows on the Government Survey thereof. <br />This Assignment is given to secure the payment of a Collateral <br />T~ Note and a Collateral Demand Note from the Assignor to <br />the Assignee, of eves date. <br />Upon any default under the note, the Assignee may <br />col3ect all rents aad profits accrued from the property and <br />all rents and profits thereafter accruing during the continuance <br />of such default. <br />Upon the delivery of this Assignment, or a -oPY <br />thereof, to any lessee or tenant of a portion of the property, <br />such lessee or tenant shall pay all rents and profits accrued <br />4r thereafter accruing to the Assignee, until further notice <br />from the Assignees. <br />The Aasigaee shall apply all rents and profits received <br />froaa the property to cLefray the expenses of collectior_ thereof <br />a~ shall ably t~ bal,anae on the last maturing payments <br />dote on the note. <br />
