CONDITIONAL ASSICNA',ENT OF LEASES AND RENTS This Assignment is executed by HEINSmAN ENGINEERING, INC., a Corporation, (Assignor) to ITT DIVERSIFIED CREDIT CORP., CO.MMPsRCIAh FINANCE DIVISION, a Corporation, (Assignee). The Assignor, in consideration of the sum of One million tight Hundred Thousand and no/100 Dollars ($2,800,000.00), received by the Assignor, hereby assigns to the Assignee, its successors and assigns, all of the rents and profits from the real estate (property) described as follows: Tract I: Apart of the NWT of the SW's of Section 27, Tawnshig 11 North, Range 9 West of the 6th P.m.: in Hall County, Nebraska, more particularly described as follows: Beginning at a point on the West line of said Section 27, Tawnshio 11 North. Rance 9 West said point being located 32.0 feet North of the NW corner of the SW} of the SW~t of said Section 27; running thence East parallel with the South line of said SW~t of the SW~ a distance of 660.0 feet; running thence North parallel with the West line of said Section 27 a distance of 336.0 feet; running thence West parallel with the South line of said SW~t of the SW~ a distance of 6bfl.0 feet, to a point on the West Sine of said Section 27; running thence South along and upon the West Sine of said Section 27 a distance of 336.0 feet to the point of beginning, subject to County Road (Now South Locus} Street). Tract II: A12 that part of the SEC of Section 27, Township 11 North, Range 20 West of the 6th P.M., in Hali County, Nebraska, lying South of the Uaion Pacific Railroad Company, as shows on the Government Survey thereof. This Assignment is given to secure the payment of a Collateral T~ Note and a Collateral Demand Note from the Assignor to the Assignee, of eves date. Upon any default under the note, the Assignee may col3ect all rents aad profits accrued from the property and all rents and profits thereafter accruing during the continuance of such default. Upon the delivery of this Assignment, or a -oPY thereof, to any lessee or tenant of a portion of the property, such lessee or tenant shall pay all rents and profits accrued 4r thereafter accruing to the Assignee, until further notice from the Assignees.
