~9- ~~~~~ <br />In consideration of the acceptance of the plat of said Hemmi.ngsen <br />Subdivision, the Subdivider hereby consents and agrees with the City <br />of Grand Island, Nebraska, that he will install or provide at his expense <br />the following improvements: <br />1. Paving. The Subdivider agrees to waive his right to object <br />to any repaving distric*_ on Stuhr Road or Biss_nark Road where they abut <br />said subdivision. <br />2. Water. The Subdivider agrees to construct the necessary water <br />main in the subdivision to serve all the lots in the subdivision in <br />accordance with plans and specifications approved by the City's Director <br />of Public t~?orks and subject to the City's inspection, and agree to <br />connect all structures in the subdivision to said city water main. <br />3. Sanitary Sewer. The Subdivider agrees to petition for the <br />construction of a sanitary sewer to serve all Lots in the subdivision <br />prior to requesti*tg any oceupancy permit for any structure in said sub- <br />division, aad agree to connect such structures to the city sanitary sewer. <br />?n the alternative, the Subdivider may construct a sanitary sewer in <br />accordance with plans and specifications approved by the City's Director <br />of Public Works and subject to the City's inspection. <br />4. Drainage. The Subdivider agrees to grade the lots in the sub- <br />division in conjunction with the structures thereon so that the storm <br />water drains to the public right-of-way. <br />5. Sidewalks. The Subdivider, if ~ti11 the owner of the lard in <br />the proposed subdivision, or if the Subdivider shall have transferred <br />title to the property, then the various grantees thereof, will irstail, <br />at their own expense, all public sidewalks required by the Grand Island <br />City Code when the adjacent lot is built upon, and sidewalks shall be <br />regulated and required with the building permit for each such lot. <br />6. Elevation. A31 residential structures shall have the lowest <br />floor elevation to a minimum of one foot above the elevation of the one <br />hundred year flaod, as determined by the building permit received by ttse <br />~SUbdivider or successors from the Build;rg i~egartment of the City of <br />Grand Island under the provisions of Section 2-15©b.t36, P.. R.S. 1943. No <br />basement shall be constructed in connection with any structure in the <br />subdivision. <br />- 2 - <br />
