E i [ ~~~ e ^ k ~~ F ~ ADD'EN'DUM TO SUBDIVISION AGREEMENT FOR VON OHLEN SECOND SUBDIVISION In The City of Grand Island, Nebraska The undersigned, Betty M. Nelson, hereinafter called the Subdivider, as owner of a tract of land comprising Von Ohlen Second Subdivision, having entered into a subdivision agreement with the City of Grand Island, on or about February 20, 1978, setting forth duties and responsibilities necessary to accomplish proper development of the aforesaid subdivision, hereby, in concurrence with the City of Grand Island through its City Engineer, wishes to amend the subdivision agreement in the following manner. 1. That paragraph 1 of the "Subdivision Agreement, Von Ohlen Second Subdivision" pertaining to Paving, be amended to read as follows: "1. Paving. The Subdivider agrees to gravel Seedling Mile Court in accordance with city plans and specifications. Furthermore, the Subdivider agrees not to object to any paving or repaving district on Shady Bend Road, Seedling Mile Road, or Seedling Mile Court, where they abut or are included in said subdivision." 2. The undersigned owner, as Subdivider, continues to warrant that she is the owner in fee simple of the land known as Van Ohlen Second Subdivision. -_ __ 3. This addendum shall become a part of the original subdivision agreement and shall run with the land and be binding upon and inure to the benefits of the parties hereto, their successors, assigns, heirs, devisees, and legatees. 4. Un1PSS specifically amended by this agreement, the original subdivision agreement for Von Ohlen Second Subdivision shall remain in full force and effect.
