<br />TEMFORAR~ EASEP3ENT
<br />THIS TEMPORARY EASEMENT AGREEMENT made as of this _1~ day of October,
<br />1479, by BETTY M, NELSON and GERALD D. NEL50N, wife and husband, of Grand Island,
<br />Hall County, Nebraska, WITNESSETH:
<br />WHEREAS, Betty M. Nelson is now the owner of Lots Three (3) and Four (4),
<br />in VON OHLEN SECOND SUBDIVISION, in the City of Grand Island, Hall County, Nebraska,
<br />and she is likewise the owner of the property immediately adjacent to and adjoining
<br />said Lots Three (3) and Four (4), on their north side in VON OHLEN SUBDIVISION,
<br />in the City of Grand Island, Nebraska; and,
<br />WHEREAS, there are now certain buildings belonging to the said Betty M.
<br />Nelson on said property immediately to the north of said Lots Three (3) and Four
<br />(4), and at the present time there is no other way of access to said buildings
<br />except across said Lots Three (3) and Four (4); and,
<br />WHEREAS, the said Gerald D. Nelson joins in this agreement with his wife,
<br />Betty M. Nelson, to bind his marital interest;
<br />NOW, THEREFORE, for good and sufficient consideration thereof, and in
<br />consideration of the mutual benefits to be derived by the owner, and by any subse-
<br />quent owners, purchasers, heir, personal or legal representatives, administra-
<br />tors, successors or assigns, the said Betty M, Nelson and Gerald D. Nelson, her
<br />husband, do hereby stipulate and agree as follows:
<br />1. A Temporary Easement is hereby specifically reserved and granted to the
<br />said Betty M. Nelson and Gerald D. Nelson, wife and husband, over, under, on, along,
<br />through, and across, for the purpose of ingress, egress, and access to and from,
<br />the following described real estate, to-wit:
<br />The Easterly Six (b) feet of Lot Three (3), and the Westerly Six (b)
<br />feet of Lot Four (4}, in Von Ohlen Second Subdivision, in the City
<br />of Grand Island, Nebraska.
<br />2. Future owners of said Lots Three (3) and Four (4), in Van Ohlen Second
<br />Subdivision, in the City of Grand Island, Nebraska, are hereby prohibited from
<br />putting up any construction, buildings, fences, utilities, trees, bushes,
<br />flowers, or any obstructions whatsoever, ovex, under, on, through or across this
<br />easement herein that would in any way whatsoever, impede or prevent the right
<br />of ingress, egr€ss, or aceess to oz Pram the property immediately adjacent to
<br />and adjoining said Lots Three (3) and Faur (4), on their North side in Von Ohlen
<br />Subdivision in the City of Grand Island, Nebraska.
<br />3. The Grantors shall not be liable fox any damages from such reasonable
<br />use of the property for the purposes herein set out.
<br />4, This temporary easement shall run with the land and shall he binding
<br />upon the subsequent owners, purchasers, heirs, personal or legal representatives,
<br />administrators, successors or assigns until such time as the necessity for the
<br />easement has terminated.
<br />IN WITNESS WHEREOF, the parties have hereunto set their hands on the
