73-, ~~~ <br />EASEMENT AGREEMENT <br />THIS AGREEMENT, made and entered into as of this 13 <br />day of September, 1979, by and between TRINITY UNITED METHODYST <br />CHURCH OF GRAND ISLAND, NEBRASKA, a religious corporation, FIRST <br />PARTY, and SHARLENE J. MOLCK, of Grand Island, Nebraska, SECOND <br />' PARTY, WITNESSETH: '- <br />WHEREAS, FIRST PARTY is the owner of Lots One (I) and <br />Two (2) in Trinity United Methodist Eastside Subdivision, in the <br />City of Grand Island, Nebraska; and, <br />WHEREAS, FIRST PARTY is now selling to SECOND FARTY <br />Lot Two (2) in Trinity United Methodist Eastside Subdivision, in <br />the City of Grand Island, Nebraska; and, <br />WHEREAS, a Subdivision Agreement was entered into by <br />and between said Church and the City of Grand Island, Nebraska, <br />on or about August 3, 1478, in which Paragr~jgh 2 thereof set Earth <br />that the Subdivider agreed that upon the transfer of Lot 2, a six <br />foot easement on the northerly six feet of Lot 1 should be granted <br />to the purchaser of said Lot 2 for the purpose of constructing a <br />private water service from the City water main in Beal Street t+~ <br />said Y.ot 2; <br />NOW. THEREFORE, in consideration of, the covenants and. <br />agreements herein referred to, the parties hereto agree as folloWS: <br />1. The FIRST PARTY hereby grants to the SECOND PARTY an <br />easement over, under and across the northerly six feet of Lot 1 in <br />Trinity United Methodist Eastside Subdivision, in the City of <br />Grand Island; Nebraska, for the purpose of constructing a private <br />water service from the City water main in Beal Street to said <br />Lot 2, together with the right to maintains repair, and replace <br />such water service, all coat to be at the expense of SECOND PARTY. <br />2. The SECOND FARTY agrees not to interfere with the <br />i <br />right-of the FIRST PASTY in the enjoyment of the land, and will re- <br />-placerand xeetore the surface of the land in as good or better <br />condition-than it nnw is and will not permit any unsightly <br />_1_ <br />
