73-, ~~~ EASEMENT AGREEMENT THIS AGREEMENT, made and entered into as of this 13 day of September, 1979, by and between TRINITY UNITED METHODYST CHURCH OF GRAND ISLAND, NEBRASKA, a religious corporation, FIRST PARTY, and SHARLENE J. MOLCK, of Grand Island, Nebraska, SECOND ' PARTY, WITNESSETH: '- WHEREAS, FIRST PARTY is the owner of Lots One (I) and Two (2) in Trinity United Methodist Eastside Subdivision, in the City of Grand Island, Nebraska; and, WHEREAS, FIRST PARTY is now selling to SECOND FARTY Lot Two (2) in Trinity United Methodist Eastside Subdivision, in the City of Grand Island, Nebraska; and, WHEREAS, a Subdivision Agreement was entered into by and between said Church and the City of Grand Island, Nebraska, on or about August 3, 1478, in which Paragr~jgh 2 thereof set Earth that the Subdivider agreed that upon the transfer of Lot 2, a six foot easement on the northerly six feet of Lot 1 should be granted to the purchaser of said Lot 2 for the purpose of constructing a private water service from the City water main in Beal Street t+~ said Y.ot 2; NOW. THEREFORE, in consideration of, the covenants and. agreements herein referred to, the parties hereto agree as folloWS: 1. The FIRST PARTY hereby grants to the SECOND PARTY an easement over, under and across the northerly six feet of Lot 1 in Trinity United Methodist Eastside Subdivision, in the City of Grand Island; Nebraska, for the purpose of constructing a private water service from the City water main in Beal Street to said Lot 2, together with the right to maintains repair, and replace such water service, all coat to be at the expense of SECOND PARTY. 2. The SECOND FARTY agrees not to interfere with the i right-of the FIRST PASTY in the enjoyment of the land, and will re- -placerand xeetore the surface of the land in as good or better condition-than it nnw is and will not permit any unsightly _1_
