<br />i7TILITIES EASEMENT <br />HARDWARE LAND CO, OF GRAND ISLAND, LTD., as Grantor, for <br />~Sru~ ~..a-~. C~f.G~i J i consideration, <br />receipt of which is hereby acknowledged, hereby grants and conveys unto <br />the <br />CITY OF GRAND ISLAND, NEBRASKA, <br />a municipal corporation in Hail County, Nebraska, as Grantee, a perpetual <br />easement and right-of-way to construct, operate, maintain, repair, replace, <br />and remove overhead and underground electric utility power lines, utility <br />poles, anchors, cables, and other appurtenances connected therewith, upon, <br />above, within, underneath and through a tract of land in part of Block <br />Fifty (50) of Packer and Barr's Second Addition to the City of Grand <br />Island, Nebraska, more particularly described as follows: <br />A sixteen (16) foot wide tract of land lying eight (S) <br />feet either side of a line described as beginning at a <br />point on the North line of said Block 50, being eleven <br />(11) feet Wes L- of the Northeast corner cf Lot 1 of said <br />Block 50; thence running southwesterly to a point one <br />hundred thirty-two (132) feet North and t'rirty-five (35) <br />feet West of the Southeast corner of Lot 2 of said fleck <br />SO of Packer and Barr's Second Addition; said tract of <br />land captaining 0.04 acre, more or less, as shown on the <br />attached plat; and <br />A tract of land for anchors and down guys, labeled "Anchor <br />cement" as shown an the plat dated bf22i:9, marked <br />$xhibit "A" attached hereto and incorporated herein by <br />reference; <br />together with the fallowing rights, namely, unrestricted ingress and <br />-----egress--~o--the 1~nd above described for the exercise of all the---ri~hta _ <br />herein granted, including clearing and keeping clear of all trees, mats, <br />fences, buildings, and ether obstructions from the surface of such ease- <br />went areas. <br />All electrical appurtenances placed within the easement area shall <br />remain the property of the Grantee and may be removed ar replaced at any <br />time. <br />The Granter, its successors and assigns, hereby covenants that no <br />-- stxueture shall be erected an such easement, and the rights herein granted <br />shall run with the title to such tracts of land and shall be binding <br />apart the Grantor, its successors and assigns. <br />Dated _~ ~- ~,-- '~,~ <br />WARE ~ #~=~(~0, RA~iDLAND, LTD. <br />% <br />,. <br />. <br />By i <br />s <br />a L., _ <br />f <br />~ <br />~ <br />a <br />~" ';i ~k; e~" ne a~axfriers <br />
