<br />GATEWAY REALTY OF GRAND ISLAND, INC., a Nebraska corporation,
<br />herein ca(l~led the Grantor, in consideration of ©IIJE
<br />1~)OL~t_.~[Z receipt of which is hereby acknowl-
<br />edged, hereby grants and conveys unto the
<br />CITY QF GRAND ISLAND, NEBRASKA,
<br />a municipal corporation in Hall County, Nebraska, herein called the
<br />Grantee, a permanent and perpetual easement and right-of-way to survey,
<br />construct, inspect, maintain, repair, replace, extend, remove, and
<br />operate thereon underground electric utility lines, cables, terminals,
<br />transformers, surface markers, and other appurtenances, connected there-
<br />with, in, upon, above, along, across, underneath and through a part of
<br />Eaglewood Acres Subdivision in Hall County, Nebraska, more particularly
<br />described as:
<br />The southerly eight (8) feet of the northerly twenty-four
<br />(24} feet of Lots Seventeen (17), Nineteen (19), and
<br />Twenty-one (21} of said Eaglewood Acres Subdivision;
<br />said tract of land containing O.Of~ acre, more or less,
<br />as shown on the plat dated 7/27179, marked Exhibit "A",
<br />attached hereto and incorporated herein by reference,
<br />together with the following rights: Unrestricted ingress and egress to
<br />the above described tract of land far installation, maintenance, opera-
<br />tion and removal of such utilities and appurtenances. Suoh rights of
<br />ingress and egress shall include all rights necessary for the full and
<br />complete use, occupation and enjoyment of the easement herein granted,
<br />including the right to excavate and refill d?.tches and trenches, to
<br />remove, clear, and keep clear trees, bushes, hedges, undergrowth, and
<br />other obstructions interfering with the surveying, construction, inspe~-
<br />tion, maintenance, repair, replacement, extension, removal or operation
<br />of such utilities. No improvements, structures, buildings, or fences
<br />of any kind whatsoever, shall be allowed in, upon, above, along, across,
<br />underneath, or through the easement herein granted.
<br />All electric utility lines, cables, terminals, transformers, surface
<br />markers, and other appurtenances placed in, upon, above, along, across,
<br />underneath, and through such easement shall remain the property of the
<br />Grantee and may be removed or replaced at any time.
