79-- p,~~8~3 <br />CORPORATION SURVIVORSHIP WARRANTY DEED <br />The Grantor, KAPA, INC., a corporation organised and existing under and by <br />virtue of the laws of the State of Nebraska, in consideration of FORTY-FIVE <br />THOUSAND FIVE HUNDRED AND NO/100 DOLLARS (45,500.00), received from Grantees, <br />does grant, bargain, sell, convey and confirm unto RUSSELL W. BIRCH and LOLA A. <br />BIRCH, husband and wife, as joint tenants with right of survivorship and not as <br />tenants in common, herein called the Grantees, the following-described real <br />property in Hall County, Nebraska: <br />A tract of land located in the North Half of the Northwest Quarter (N~NW~) <br />of Section Twenty-sevef~ (27), Township Twelve (12) North, Range Nine (9), <br />West of the 6th P.M., more particularly described as follows: Beginning at <br />the northwest corner of said NNW<> thence westerly along and upon the <br />north line of said N?~tdW4 a distance of Three Hundred Thirty-one and Eighty- <br />five Hundredths Feet (331.85'); thence southerly along and upon the line <br />which is Three Hundred Thirty-one and Eighty-five Hundredths Feet (331.85') <br />westerly and parallel to the east line of said N~tiW~a a distance of One <br />Thousand Three Hundred Thirty-one and No One-hundredths feet (1331.0'} to a <br />point on the south line of said NNW;; thence easterly along and upon the <br />south line of said N~tiW~a a distance of Three Hundred Thirty-one and Eighty- <br />five Hundredths Feet {331.85') to the southeast corner of said N~NWra; <br />thence northerly along and upon the east line of said N~tIW; a distance of <br />One Thousand Three Hundred Twelve and Three-tenths Feet (1312.3') to point <br />of beginning and containing Nine and Seventy-four Hundredths (9.74} acres, <br />more or less, of which Twenty-five Hundredths (0.25) acres is presently <br />occupied by County Road right-of-way. <br />TO HAVE AND TO HOLD the above-described premises together with all tenements, <br />hereditaments and appurtenances thereto belonging unto the Grantees and to their <br />assigns, or to the hairs and assigns of the survivor of them forever. <br />And the Grantor, for itself and its successors and assigns, does hereby <br />covenant with the Grantees and with their assigns and with the heirs and assigns <br />of the survivor of them that Grantor is lawfully seized of said premises; that <br />they are free from encumbrance except any easements, restrictive covenants of <br />record or any other encumbrances of record; that Grantor has goad right and <br />lawful authority to convey the same; and that Grantor warrants and will defend <br />the title to said premises against the lawful claims of aTl persons whomsoever. <br />It is the intention of all parties hereto that in the event of the death of <br />either of the Grantees, the entire fee simple title to the real estate shall <br />vest in the surviving Grantee. <br />------- - --- <br />IN WITNESS WHEREOF, Grantor has hereunto Caused these presents to be signed- <br />by its President. <br />Dated September [c 1979. <br />ATTEST: <br />~.~-~ ~ l <br />Karen R.
