<br />E. N. ROE and AtERLENE ROE, husband and wife, each in his and
<br />her own right and as spouse o£ the other, herein called the Grantors,
<br />in consideration of One Dollar ($l.OC}, receipt of which is hereby acknowl-
<br />edged, hereby grant and convey unto the
<br />,, CZTY OF ^vRAAID ISLAND, NEBRASKA,
<br />a municipal corporation in Aall County, Nebraska, as Grantee, a permanent
<br />and perpetual right-of-way and easement to construct, operate, maintain, -"
<br />extend., repair, replace, and remove public utilities, including but not
<br />limited to, water mains, pipelines, surface markers, hydrants, and other
<br />appurtenances upon, over, along, across, underneath and through the tract
<br />of land and real estate described as the westerly ten {10} feet of that-
<br />part of Frontage Road which abuts the east SO feet, or 15.246 meters,
<br />of Lot 2, and all of Lat 3, Commercial Ind~.;strial Park Second Subdivision
<br />to the City of Grand Island, nebraska, as vacated by Ordinance No. b450,
<br />- together with all rights of ingress and egress for the installation and
<br />maintenance of such public utilities.
<br />Such rights of ingress -shall include alI rights necessary-for -
<br />the full and complete use, occupation, and enjoyment of the easement herein
<br />- granted, including the sigh-c to excavate and refill ditches and trenches,
<br />end the_rght to xemove-trees,,bushes., hedges-, undergrowth, and.-othe~_
<br />~~~siructions interierring with the location, construction, inspection,
<br />repair, replacement, removal, and maintenance of such utilities.
<br />All structures, surface markers, pipes, hydrants, and all
<br />.other appurtenances placed upon, over, within, undereeath and through
<br />`-such easement shall remain the property of the Grantee and may be removed
<br />cxr replaceri at any time. -
<br />The Grantors, for themselves, their heirs, devisees, executors,
<br />administratArs,-and assigns hereby covenant that na structures or other
<br />.obstructions.-shall be erected or permitted on such tract of land.
