The title of the real estate shall be free and clear of any and all encumbrances except the easements, covenants and restrictions of record and the aforementioned loan to Equitable. Also unpaid taxes which are not delinquent shall not be cansidered a cloud on the title. 7. If objection to the title is made, based upon a written opinion of the examining attorney, the title is not in the condition required hereunder, Sellers shall have thirty (30) days from the date they are notified of the particular defect either (a) remedy the title or (b) refund any monies paid, if they are unable to remedy the title; provided, however, the Buyers may waive such title defect ~,:nless e"tend@d by written a'gree~iient of the partir`S, this Contract shall be completed and the transaction closed and possession on or before August 10, 1980.
