<br />E A S E M E N T <br />Lutheran Homes, Inc., herein called the Grantor, in con- <br />sideration of One Dollar, receipt of which is hereby acknowledged, <br />hereby grants and conveys unto the <br />CITY OF GRAND ISLAND, NEBRASKA, <br />a municipal corporation in Hall County, Nebraska, as Grantee, <br />a permanent and perpetual easement to construct, operate, main- <br />tain, repair, replace, and remove underground electrical <br />transmission and distribution lines, in, upon, and underneath, <br />and through a tract of land located in part of Dau Subdivision <br />in Grand Island, Hall County, Nebraska, more particularly des- <br />cribed as follows: <br />Beginning at a point on the North line of the Northwest <br />Quarter of the Southwest Quarter (NW~SW'~y) of Section <br />Seventeen (17), Township Eleven (11) North, Range Nine <br />(9) west of the 6th P. M., Ha11 County, Nebraska,said <br />point being fourteen (l4} feet West of the Northeast <br />Corner of said Northwest Quarter of the Southwest Quarter <br />(NW~SW~); thence running westerly along the North line of <br />the said Northwest Quarter of the Southwest Quarter (NW'~SW'~) <br />for a distance of sixteen (16} feet; thence running southerly <br />parallel to the East line of said Northwest Quarter of the <br />Southwest Quarter (N~r~SW~) for a distance of sixty (60) feet; <br />thence deflecting 45 and running Southeast for a distance <br />of one hundred twenty-five (125) feet; thence deflecting <br />~Qa and Ytinn iil~ NnrthE?act a dictan~a of citeen (l 6) font <br />thence deflecting 40~ and running Northwest a distance of <br />one hundred eighteen and founttenths (113.4} feet to a <br />.~ <br />paint fcurtePn ,_4) feet ::?est of she East line of the said <br />Northwest Quarter of the Southwest Quarter (NW~SW~}; thence <br />running northerly parallel to the East line of the said <br />Northwest Quarter of the Southwest Quarter (NW~SW~) a <br />distance of fifty-three and four-tenths (53.4} feet to the <br />point of beginning, said tract of land containing 0.06 acre, <br />more or Less, as shown on the plat dated 3/23;79, marked <br />Exhibit "A" attached hereto and incorporated herein by <br />reference, <br />together with the following rights, namely: Unrestricted <br />ingress and egress within, through, and across the above des- <br />cribed tract of land for the purpose of exercising the rights <br />h~Fei n grc.a.~.cd, atEd the ~ij~-,ht ~~: Glean and keep clear of trcc$, <br />roots, brush, shrubbery, and other obstructions from the surface <br />of such easement area. <br />A11 underground electric lines placed within the easement <br />area shall remain the property of the Grantee and may be re- <br />moved ar replaced at any time. <br />
