~„ ._ ASSIGN2~23T WHE.TtEAS, on the 9th day of May, 1978, Spelts-Schultz Lumber Ct. of Grand Island executed a warranty deed to the State of Nebraska _, which deed was recorded in the Office of the Register of Deeds of Hail County, Nebraska, as Document 78-005293; WHEREAS, in addition to the consideration recited in such deed, the State of Nebraska agreed pursuant to a right-of-=aay contract executed on 3uly 31, 1978, a copy of which is attached hereto and made a part of this Assignment as though fully set forth herein, to provide for the existing access to old U. S. Highway 30 to be relocated by the State of Nebraska at a satisfactory location and access privileges to old U. S. Highway 30 for road purposes to be given to Spelts-Schultz Lumber Ca. of Grand Island and, in addition thereto, the State of Nebraska agreed to grant easements for utilities in the said relocated access corridor; WHEREAS, Spelts-Schultz Lumber Co. of Grand Island dedicated and filed a plat in the Office of the Register of Deeds of Hall County, Nebraska, recorded as Document No. 79-t}0~+192 establishing Spelts-Schultz Industrial Subdivision in the City of Grand Island, Nebraska, incorporating the property referred to in the right-of- way contract attached hereto and marked Exhibit A to which the access rights so referred to were appurtvsiant. WHEREAS, on the 29th day of June, 1979, Spelts-Schultz Lumber Co. of Grand Island conveyed Lot One (1), Spelts-Schultz Industrial Subdivision, City of Grand Island, Hall County, Nebraska, to Mid-America Go., which conveyance is recorded as Docai*n?nt No. 79-004193 in the Office of the Register of Deeds of Hall County, Nebraska, and the only access to such Lot 1 in Spelts-Schultz Industrial Subdivision available would be the access to be relocated pursuant to the right-of-~~=av contract attached hereto and marked Exhibit A. NOW, THEREFORE, in consideration of valuable consideration heretofore exchanged, Spelts-Schultz Lumber Co. of Grand Island hereby and by these presents does assign, transfer, and grant to Mid-America Co., a Nebraska corporation, all rights agreed to by the State of Nebraska pertaining to relocating the access to ald U. S. Highway 30 and the grant of easement for utilities in said relocated access corridor, as more fully set forth on Exhibit A hereto.
