<br />NEBRASKA MIL-NIC, INC., a Nebraska corporation, herein called the
<br />Grantor, in consideration of pp}~ ~ptLf~Q ~ ~ f ~ ~ _
<br />receipt of which is hereby acknowledged, hereby grants and conveys unto
<br />the
<br />CITY OF GRAND ISLAND, NEBRASKA,
<br />a municipal corporation in Ha11 County, Nebraska, herein called the
<br />Grantee, a permanent and perpetual easement and right-of-way to survey,
<br />construct, inspect, repair, replace, remove, and operate thereon, under-
<br />ground electrical distribution lines, water distribution lir:es, North-
<br />western Bell Telephone Company cables, cable television lines, and other
<br />appurtenances connected with such utilities upon, above, across, under-
<br />neath and through the tracL~ of land and real estate described as follows:
<br />The southerly eight (8) feet of Lot Twe (2); and
<br />The southerly eight (8) feet of the ccesterly two hundred
<br />thirty-tcao (232) feet of Lot Three (3); and
<br />The northerly s~.xteen (16} feet of the southerly thirty
<br />(30) feet of the easterly forty-five (45) feet of Lot
<br />Three (3);
<br />All in Mil-Nic Additiea in the City of Grand Island,
<br />Nebraska, said tracts of land containing 0.13 acre, more
<br />or lass, as shocm on the plat dated 5i3;`i9, marked Exhibit
<br />"A", attached hereto and incorporated herein by reference;
<br />together with all rights of unrestricted ingress and egress for installa-
<br />tion and mairtenar_ce of such utilities and appurtenances.
<br />Such rights of ingress and egress shall include all rights necessary
<br />for the full and complete use, occupation and enjoyment of the easements
<br />herein granted, including the right to excavate and refill ditches and
<br />trenches, to remove trees, bushes, '.;edees, undergroc,-th, and other ob-
<br />structions interferrang with the ioeatior,, construction, inspection,
<br />repair, replacement. removal and main tenarce of suc~ utilities, do
<br />impro.=ements, structures, or buildings of any kind whatsoever shall be
<br />allowed ir_, upon, or ever the easement herein granted. Gran*_or and
<br />Grantee agree t?:at Grantor ,.>hall have the right to pave over the easement
<br />area and use the easement area for parking and ingress and egress, pro-
<br />vided, if the Grantee needs to construct, operate, maintain, extend,

<br />repair, replace, or remove anything within such easement, the cost of
<br />removal and repair.of ~ciy paving placed over such easement shall be paid
