In <br />consideration of the acceptance of the plat of said Medical Park Fourth. <br />Subdivision, the Subdivider hereby consents and agrees with the City of <br />Brand Island, Nebraska, that it will install or provide at its expense <br />the following improvements: <br />1. Pavin The Subdivider agrees to pave Alpha Street in accordance <br />with plans and specifications approved by the City's Director of Public <br />Works, subject to the City's inspection. In the alternative, the Sub- <br />divider may petition for the creation of a street improvement district <br />for purposes of improving 91pha Street where it lies within said sub- <br />division. <br />~~t~ The s::bd~.~de~ agr~es to ~„nstru~t any and all ~.e~~aaary <br />water mains within said subdivision in accordance with plans and speci- <br />fications approved by the City's Director of Public Works, subject to <br />the City's inspection, prior to the issuance of any occupancy permit for. <br />any structure ;within said subdivision; provided, the City shall assume <br />the cost of loaping the caater main from approximately the Southeast <br />Corner of Lot Nine (9) to the North side of Tenth Street, and the cost <br />of stubbing the line £ast across Alpha Street on the North side of <br />Faidlev Avenue of said subdivision. <br />3. Sanitary Sew=er. Sanitary Secaer service is available to all <br />lots within said subdivision subject to any and all connection fees or <br />acgeScmentc_ <br />=~. Drainage. The Subdivider agrees to connect to an existing <br />private stort^. or water detention cell located on their property, and <br />provide an avers`?ow connec*_ion to the City's storm sewer system located <br />in :'aidlev Avenue in accordance with plans and specifications approved <br />by the City's Director of ?ublic norks, such cell being subject to <br />enlargement if reruired, as a result of an increase in storm water <br />drainage in the area at the Subdivider's expense, upon the direction of <br />thz City's Director of Public Works.
