<br />REAL ESTATE MORTGAGE <br />BILLY D. JUSSEL and BETTY J. JUS5EL, herein called the <br />Mortgagors, in consideration o.f THIRTY-FIVE THOUSAND AND NO/100 <br />DOLLARS ($35,000.00) do hereby mortgage to STEVE M. HALPIN and <br />MARGARET J. HALPIN as joint tenants and not as tenants in common <br />with right of survivorship, herein called the Mortgagees, the <br />following described real estate in Hall County, Nebraska: <br />The Southerly Sixty-Eight Feet (68') of Lot One (1) <br />in Block Forty-Eight (48) in Russel Wheeler's <br />Addition to the City of Grand Island, Hall County, <br />Nebraska. <br />This Mortgage is given to secure the payment of the principal <br />sum of THIRTY-FIVE THOUSAND AND NO/1C0 DOLLARS ($35,000.00) and <br />interest thereon, according to the terms of a certain Promissory <br />Note of even date, executes: by the Mortgagors to the Mortgagees, <br />due the 15th Say of July, 1984. <br />The Mortgagors further agree to maintain insurance upon the <br />above-described gremises in an amount not less than the indebtedness <br />due the Mortgagees with a loss-payable clause in favor of Mortgagors <br />and Mortgagees as their interests may appear. The Mortgagors <br />agree to nay all ta?~es and assessments anon said premises and all <br />other taxes, levies and assessments levied upon this Mortgage and <br />the Note which this Mortgage is given to secure before the same <br />become delinquent. In the -event the Mortgagors shall fail to <br />obtain such insurance or pay such taxes before delinquent, the <br />Mortgagees may purchase such insurance and pay such taxes or <br />other liens and shall have a lien secured hereby for the amount <br />so adeanced with interest thereon at the rate of nine and one-half <br />per cent (9~8) per annum. <br />In the event the Mortgagors default in the payment of said <br />indebtedness or any installment thereof, or fail to perform any <br />of the other agreements herein, the Mortgagees at election may <br />declare the entire debt secured by this Mortgage to be due and <br />collectible at once; and may foreclose this Mortgage for the <br />satisfaction thereof. <br />The Mortgagors further agree that payment hereunder shall be <br />made to Mortgagees as joint tenants and in the event of the death <br />of either of said Mortgagees, all payments due hereunder shall be <br />made to the survivor of them who may execute and deliver a release <br />hereof which shall extinguish the interests of all Mortgagees <br />hereunder. <br />Signed this ~_ 3ay of June, 1979. <br />, ~'', t <br />Bill.
