<br />79- ;;t,p~38 <br />REAL ESTATE MORTGAGE <br />BILLY D. JUSSEL and BETTY J. JUSSEL, herein called the <br />Mortgagors, in consideration of THIRTY-FIVE THOUSAND AND NO/100 <br />DOLLARS {$35,000.00) do hereby mortgage to STEVE M. HALPIYd and <br />?dARaRRET J. HALPIN as joint tenants and not as tenants in common <br />witn right of survivorship, herein called the Mortgaycd5, the <br />following described real estate in Hall County, Nebraska: <br />A tract of land 56 feet in width and 132 feet in length, <br />formerly being a part of West 11th Street, of the City of <br />Grand Island vacated by said City October 5, 1960, and more <br />particularly described as follows: <br />Beginning at the Northwest corner of Lot Six (6), Block <br />Fifteen {15) West Park Addition to the City of Grand Island, <br />running thence East on the North line of said Lot Six (6) <br />for a distance of 132 feet, to the Northeast corner of Lot <br />Six (6); thence North on a prolongation of the East line of <br />said Lot Six (6) for a distance of 56 feet, running thence <br />West parallel to the North line of said Lot Six (6) for a <br />distance of 132 feet, running thence South on a prolongation <br />of the West line of said Lot Six (5) for a distance of 56 <br />fret to the Northwest rnrner of Lot Six f61, being the point <br />of beginning, all in the City of Grand Island, Hall County, <br />Nebraska, <br />This Mortgage is given to secure the payment of the principal <br />sum of THIRTY-FIVE THOUSAND AND NO,~100 DOLLARS ($35,OOfl.0O) and <br />interest thereon, according to the terms of a certain Promissory <br />Note of even date, executed by the Mortgagors to the Mortgagees, <br />due the 15th day of Duly, 1984. <br />The Mortgagors further agree to maintain insurance upon the <br />above-described premises in an amount not less than the indebtedness <br />due the Mortgagees with a loss-payable clause in favor of Mortgagors <br />and Mortgagees as their interests may appear. The Mortgagors <br />agree to pay all taxes and assessments upon said premises and all <br />other taxes, Levies and assessments levied upon this Mortgage end <br />the Nate which this Mortgage is given to secure before the sate <br />become delinquent. In the event the Mortgagors shall fail to <br />obtain such insurance or pay such taxes before delinquent, the <br />Mortgagees may purchase such insurance and pay such taxes or <br />other liens and shall have a lien secured hereby for the amount <br />so advanced with interest thereon at the rate of nine and one-half <br />per cent (9;~) per annu,~:. <br />In the event the Mortgagors default in the payment of said <br />indebtedness or any installment thereof, or fail to perfazn any <br />of the other agreements herein, the ?9ortgagees at election may <br />declare the entire debt secured by this Mortgage to be due and <br />collectible at once; and may foreclose this Mortgage for the <br />satisfaction thereof. <br />The Mortgagors further agree that payment hereunder shall be <br />made to Mortgagees as joint tenants and in the event of the death <br />of either of said Mortgagees, all pay-.ents due hereunder shall he <br />made to the survivor of them who may execute and deliver a release <br />hereof which shall extinguish the interests of all Mortgagees <br />hereunder. <br />Signed this ~ day of June, 1979. <br />p `f., <br />t,k, ~ <br />Bill D. ~sel <br />Betty J is~i <br />-1- <br />
